{"data":{"id":"us-ky/krs-154.12-2088","jurisdiction":"us-ky","citation":"KRS 154.12-2088","heading":"Guidelines -- Application -- Preliminary approval -- Final authorizing","body":"resolution.\n(1) The Bluegrass State Skills Corporation shall establish guidelines and standards for\napproving skills training investment credits for occupational upgrade traini ng and\nskills upgrade training. The guidelines and standards may include, but are not\nlimited to: required hours of classroom instruction; required courses; certification of\nteachers or instructors, whether independent contractors or employees of a qualifi ed\ncompany; certification of providers; progressive levels of instruction; and\nstandardized measures of employee evaluation to determine successful completion\nof a course of study.\n(2) To apply for skills training investment credits under KRS 154.12 -2084 to 154.12-\n2089, a qualified company shall submit an application to the Bluegrass State Skills\nCorporation before commencing its program of occupational upgrade training or\nskills upgrade training. The application submitted by the qualified company shall\ncontain information the Bluegrass State Skills Corporation requires including, but\nnot limited to:\n(a) A proposal for a program of occupational upgrade training or skills upgrade\ntraining;\n(b) A description of each component of the proposed training program a nd the\nnumber of employee training hours requested;\n(c) A statement of all anticipated costs and expenses of the training program,\nincluding the costs and expenses associated with employee wages, equipment,\npersonnel, facilities, and materials; and\n(d) Auditing procedures and reporting methods for the submission of information\nand data to the Bluegrass State Skills Corporation.\n(3) After a review of applications for skills training investment credits, the Bluegrass\nState Skills Corporation may designate the  qualified company as a preliminarily\napproved company and preliminarily approve the amount of skills training\ninvestment credits that the qualified company shall be eligible to receive. The\nmaximum amount of skills training investment credits preliminaril y approved for\nall qualified companies by the Bluegrass State Skills Corporation for fiscal year\n1998-1999 and fiscal year 1999 -2000 shall not exceed one million dollars\n($1,000,000) and shall not exceed two million five hundred thousand dollars\n($2,500,000) for each fiscal year thereafter. Skills training investment credits shall\nbe allocated to qualified companies in the same order preliminary approval is\ngranted by the Bluegrass State Skills Corporation. Skills training investment credits\nthat remain una llocated by the Bluegrass State Skills Corporation at the end of its\nfiscal year shall lapse and shall not be carried forward to a new fiscal year.\n(4) The preliminarily approved company shall complete all programs of occupational\nupgrade training or skill s upgrade training within one (1) year from the date of the\npreliminary approval of the skills training investment credits by the Bluegrass State\nSkills Corporation and shall certify the completion of these programs to the\nBluegrass State Skills Corporation.\n(5) The preliminarily approved company shall maintain in its employment the\nemployees receiving occupational upgrade or skills upgrade training for a minimum\nof ninety (90) days following the completion of the program of occupational\nupgrade training or  skills upgrade training and shall certify to the Bluegrass State\nSkills Corporation the number of employees who remained in the employment of\nthe preliminarily approved company for the full ninety (90) day period.\n(6) If a qualified company concludes its training program within the prescribed one (1)\nyear and receives the required certifications described in subsections (4) and (5) of\nthis section, then the Bluegrass State Skills Corporation shall adopt a final\nauthorizing resolution approving the amount o f skills training investment credits\nawarded to the preliminarily approved company in accordance with KRS 154.12 -\n2084 to 154.12 -2089. The adoption of a final authorizing resolution shall be\ncontingent upon the Bluegrass State Skills Corporation's approval of documentation\nsubmitted by the preliminarily approved company supporting all incurred approved\ncosts. If one (1) or more of the employees of the preliminarily approved company\nfailed to continue in the employment of the company for ninety (90) days foll owing\nthe completion of the prescribed one (1) year, then the amount of the skills training\ninvestment credits preliminarily approved for a qualified company shall be reduced\non a pro rata basis for each employee who failed to continue employment with the\npreliminarily approved company through the ninety (90) day period. The final\namount of the skills training investment credits awarded to the approved company\nshall not exceed the amount of skills training investment credits that the approved\ncompany was preliminarily approved for by the Bluegrass State Skills Corporation\nprior to commencement of the training program.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=2625","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:52Z","sha256":"4311aab74b8e6a6302d3b504ba4981773af080e6189491455d88087bbd651928","source_id":"us-ky","stale":false,"prev":"us-ky/krs-154.12-2087","next":"us-ky/krs-154.12-2089"},"notice":"GroundRules: Original legal text.
