{"data":{"id":"us-ky/krs-154.12-282","jurisdiction":"us-ky","citation":"KRS 154.12-282","heading":"Kentucky Film Leadership Council -- Purpose -- Membership.","body":"(1) There is hereby established the Kentucky Film Leadership Council. The council\nshall be administratively attached to the Kentucky Film Office established in KRS\n154.12-280.\n(2) The functions and purposes of the council shall be to:\n(a) Review all applications for tax incentives under KRS 141.383 and Subchapter\n61 of KRS Chapter 154;\n(b) Review all related documents presented by the office;\n(c) Make a final decision at a mee ting held at the call of the chair regarding\nwhether to authorize a tax incentive agreement if the cabinet's economic\nanalysis supports the project. The cabinet shall be responsible for negotiating,\npreparing, and executing tax incentive agreements under this section;\n(d) Recommend policies and standards for the Kentucky Film Office;\n(e) Develop comprehensive film industry strategies in partnership with the\nCabinet for Economic Development, the Tourism, Arts and Heritage Cabinet,\nand the Education and Labor Cabinet;\n(f) Partner with local and regional film offices, production studios, and relevant\nworkforce training programs in Kentucky; and\n(g) Conduct a nationwide search for the executive director of the Kentucky Film\nOffice and make decisions regarding hi ring and compensation. The salary of\nthe executive director of the office shall not exceed two hundred twenty -five\nthousand dollars ($225,000) and shall be exempt from KRS 64.640.\n(3) (a) The council shall consist of the following seven (7) voting members:\n1. The secretary of the Cabinet for Economic Development or his or her\ndesignee;\n2. The secretary of the Tourism, Arts and Heritage Cabinet or his or her\ndesignee;\n3. The secretary of the Education and Labor Cabinet or his or her designee;\nand\n4. Four (4) members who shall be appointed by the Governor as follows:\na. Two (2) representatives from Kentucky film production\ncompanies;\nb. One (1) representative from a film pr ofession, including but not\nlimited to producers, actors, production accountants with film\nindustry experience, or film financiers; and\nc. One (1) representative who is the head of a local or regional film\ncommission.\n(b) All members appointed by the Gover nor under this subsection shall have\nknowledge of or experience in the Kentucky film industry. After the\nexpiration of their initial terms, the appointed members shall serve a term of\nfour (4) years and until a successor is appointed and qualified. Any vac ancy\nthat occurs shall be filled for the unexpired term in the same manner as the\noriginal appointment. All members appointed by the Governor shall be\nsubject to confirmation by the Senate as provided in KRS 11.160.\n(c) A majority of the members shall appo int the chair from among the members\nof the council.\n(d) Members shall serve without compensation but shall be reimbursed for\nnecessary travel expenses.\n(e) The council shall meet at the call of the chair, but not less than quarterly.\n(f) A quorum shall be a majority of the membership of the council.\n(g) A member of the council shall not be subject to any personal liability or\naccountability by reason of the execution of any obligation duly authorized by\nthe council.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58151","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:52Z","sha256":"d8b8e03d6a2144e8b7b090a2e297a971a7dee156de0ada6c2ec74227da5ea9ef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-154.12-280","next":"us-ky/krs-154.12-300"},"notice":"GroundRules: Original legal text.
