{"data":{"id":"us-ky/krs-154.27-100","jurisdiction":"us-ky","citation":"KRS 154.27-100","heading":"Construction of carbon dioxide transmission pipeline -- Proceedings for","body":"condemnation under Eminent Domain Act -- Legislative determination of\nessential public use.\n(1) For the purposes of this section, \"carbon dioxide transmission pipeline\" has the\nsame meaning as in KRS 154.27-010.\n(2) If a carbon dioxide transmission pipeline company has received a construction\ncertificate from the Kentucky State Board on Electric Generation and Siting under\nKRS 278.714 and is unable to contract or agree with the owner after a good -faith\neffort to do so, the company may condemn the lands and material for the use and\noccupation of the lands that are necessary for:\n(a) Constructing, maintaining, utilizing, operating, and gaining access to a carbon\ndioxide transmissio n pipeline and all necessary machinery, equipment,\npumping stations, appliances, and fixtures for use in connection with a carbon\ndioxide transmission pipeline; and\n(b) Obtaining all necessary rights of ingress and egress to construct, examine,\nalter, repa ir, maintain, operate, or remove a carbon dioxide transmission\npipeline and all of its component parts.\n(3) The proceedings for condemnation shall be as provided in the Eminent Domain Act\nof Kentucky.\n(4) Carbon dioxide transmission pipelines, and the rout ing, construction, maintenance,\nand operation of them are, as a matter of legislative determination, declared to be a\npublic use essential to the fulfillment of the purposes of this chapter.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39830","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:55Z","sha256":"45a6d7c3ba223e817dbf81ded3ca1dd0bf9766f0b8013dd4c604dc1bfea2d399","source_id":"us-ky","stale":false,"prev":"us-ky/krs-154.27-095","next":"us-ky/krs-154.270"},"notice":"GroundRules: Original legal text.
