{"data":{"id":"us-ky/krs-154a.090","jurisdiction":"us-ky","citation":"KRS 154A.090","heading":"Appeals -- Circuit Court alternatives.","body":"(1) Any retailer, vendor, or applicant for a retailer or vendor contract aggrieved by an\naction of the president of the corporation may appeal that decision to the board.\n(2) All appeals before the board shall be decided within thirty (30) days of the hearing.\n(3) Any person aggrieved by a decision of the board may appeal the decision to the\nCircuit Court of the county in which the corporation maintains its headquarters,\nexcept that if the person aggrieved is a lottery retailer or an applicant to become a\nlottery retailer, then the Circuit Court of the county in which said retailer does or\napplicant would operate shall have concurrent venue as to such appeal.\n(4) The Circuit Court may reverse the decision of the board only in the event the\ndecision is found to be:\n(a) Clearly erroneous; or\n(b) Arbitrary and capricious; or\n(c) Procured by fraud; or\n(d) A result of misconduct by the board, or a member thereof.","path":["KRS Chapter 154A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3017","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:58Z","sha256":"3c2f1873905649d9c7e569eb0b232d01e0c93b72cc0caf5b7dabc1a32c5927cc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-154a.080","next":"us-ky/krs-154a.100"},"notice":"GroundRules: Original legal text.
