{"data":{"id":"us-ky/krs-156.010","jurisdiction":"us-ky","citation":"KRS 156.010","heading":"Commissioner's authority to organize Department of Education --","body":"Composition -- Functions.\n(1) The commissioner of education shall be the chief executive of the Department of\nEducation. The commissioner shall be responsible for administering, structuring,\nand organizing the department and its services, including but not limited to the\nfollowing:\n(a) Technical assistance with curriculum design, school administration and\nfinance, computer and technology services, media services, community\neducation, career and technical education, STEM education as defined in KRS\n158.845, education for exceptional children, and professional development;\n(b) Compensatory education;\n(c) Research and planning, which shall include, but not be limited to, a statewide\nresearch and development effort to identify or develop the best educational\npractices to be used in the public schools of the Commonwealth.\nAppropriations for this purpose may be used within the department or for\ncontracting with other individuals, agencies , universities, laboratories, or\norganizations;\n(d) Kentucky School for the Blind and the Kentucky School for the Deaf;\n(e) Performance and outcome assessments;\n(f) Monitoring the management of school districts, including administration and\nfinance, implem entation of state laws and regulations, and student\nperformance; and\n(g) Implementing state laws and the policies promulgated thereunder by the\nKentucky Board of Education and the Education Professional Standards\nBoard.\n(2) The commissioner of education ma y delegate any authority to act on the\ncommissioner's behalf in the supervision, inspection, and administration of the\nschools to the extent the commissioner has supervisory and administrative control.\n(3) All employees of the Department of Education shall  be reimbursed for necessary\ntraveling expenses incurred in the performance of their official duties, and no part\nof the reimbursement shall be included in or accounted as a part of their salaries.\n(4) The State Department of Education, in the operation and management of its schools\nand the programs at these schools, shall meet all required federal and state standards\nrelating to facilities and personnel qualifications; however, no license or license fee\nshall be required for any school or program operated by the State Department of\nEducation.\n(5) The Department of Education shall be the sole state agency for the purpose of\ndeveloping and approving state plans required by state or federal laws and\nregulations as prerequisites to receiving federal funds for elementary and secondary\neducation.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56269","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:59Z","sha256":"4f2e7d44144e03dd5ff85168ce53eb202c233f46ee9b505111ed6515b2efd3ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.007","next":"us-ky/krs-156.015"},"notice":"GroundRules: Original legal text.
