{"data":{"id":"us-ky/krs-156.016","jurisdiction":"us-ky","citation":"KRS 156.016","heading":"Abolition of employment positions -- Reorganization.","body":"(1) Effective at the close of business on June 30, 1991, all employment positions in the\nDepartment of Education shall be abolished and the employment of all employees\nin the positions shall be terminated. Employees whose employment has been\nterminated under t he provisions of this section shall have the same reemployment\nrights granted career employees by KRS Chapter 18A, except these employees shall\nnot have priority status on the register for reemployment in the Department of\nEducation. This shall not be cons trued as prohibiting the Department of Education\nfrom rehiring an employee whose employment has been terminated.\n(2) After a comprehensive study of the Department of Education and the goals and\nduties of the commissioner of education and the department as established under the\nKentucky Education Reform Act of 1990, 1990 Ky. Acts Ch. 476, the\ncommissioner shall reorganize the department, effective July 1, 1991. The\nreorganization of the department shall incorporate a strong orientation toward\nproviding techn ical assistance to school districts. After the comprehensive study,\nwhich shall include consultations with current department employees, the\ncommissioner shall establish all positions in the department and set the\nqualifications for the positions, effectiv e no earlier than July 1, 1991. The\ncommissioner may rehire any department employees whose employment is\nterminated at the close of business on June 30, 1991, under this section.\n(3) This section is in response to a specific court decision demanding specific actions of\nthe General Assembly. The actions authorized by this section are designed for a\nsingle time use only in response to the education situation.
