{"data":{"id":"us-ky/krs-156.035","jurisdiction":"us-ky","citation":"KRS 156.035","heading":"Legal status of board -- Administration of fund.","body":"(1) The Kentucky Board of Education is recognized to be a public body corporate and\npolitic, and an agency and instrumentality of the Commonwealth in the performance\nof essential governmental functions.\n(2) For the benefit of programs under its control and sup ervision, the board is\nauthorized to implement the provisions of any Act of Congress appropriating and\napportioning funds to the state, to receive funds appropriated by the Kentucky\nGeneral Assembly, to provide for the proper apportionment and disbursement  of\nsuch funds in accordance with state or federal laws, and to accept and provide for\nthe administration of any gifts, donations, or devises.\n(3) (a) The board is authorized to expend funds necessary for errors and omissions\ninsurance premiums for insuran ce to cover the defense of, and any damages\nand costs awarded in, any civil action brought against individual board\nmembers on account of an act made in the scope and course of their\nperformance of legal duties as board members.\n(b) The authorization of th e expenditure of public funds for insurance is deemed\ncritical to continuing to attract qualified individuals to become members of\nstate boards, and is deemed to authorize the expenditure of public funds for a\npublic purpose.\n(c) Nothing in this subsection  shall be construed as a waiver of the sovereign\nimmunity of the Commonwealth with respect to claims against the Kentucky\nBoard of Education, the Department of Education, or any of their respective\nofficers, agents, or employees.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3104","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:59Z","sha256":"0c401700e1084e671706bae23a90a768cb67bd31890e459198af2fae6e01735e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.033","next":"us-ky/krs-156.040"},"notice":"GroundRules: Original legal text.
