{"data":{"id":"us-ky/krs-156.106","jurisdiction":"us-ky","citation":"KRS 156.106","heading":"Critical shortage areas -- Definition for section and KRS 161.605 --","body":"Appointment of retired teachers and administrators.\n(1) For purposes of this section and KRS 161.605, \"critical shortage area\" means a lack\nof certified teachers in particul ar subject areas, in grade levels, or in geographic\nlocations at the elementary and secondary level, as determined annually by the\ncommissioner of education. The commissioner may use any source considered\nreliable including, but not limited to, data provid ed by the Education Professional\nStandards Board and local education agencies to identify the critical shortage areas.\n(2) (a) The Kentucky Board of Education shall promulgate administrative regulations\nto establish procedures to be used to appoint retired  teachers and\nadministrators to positions in critical shortage areas under this section and\nKRS 161.605.\n(b) A retired teacher or administrator appointed to a position in a critical shortage\narea shall be paid, at a minimum, a salary at Rank II with ten (1 0) years of\nexperience based on a single salary schedule adopted by the district.\n(c) The commissioner of education shall report members reemployed under this\nsection to the Kentucky Teachers' Retirement System.\n(3) If a local school district needs a perso n to fill a critical shortage position after\nreaching its quota established under KRS 161.605, the commissioner of education\nwith the approval of the executive director of the Kentucky Teachers' Retirement\nSystem may allow the district to exceed its quota if the statewide quota has not been\nmet.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56505","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:59Z","sha256":"e05be228958d8b01c925da0b5844f5587f2be1fa196892217cf44fae6dc4483c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.105","next":"us-ky/krs-156.108"},"notice":"GroundRules: Original legal text.
