{"data":{"id":"us-ky/krs-156.1611","jurisdiction":"us-ky","citation":"KRS 156.1611","heading":"Expedited waivers -- Expiration -- Rescission of waiver -- Appeal of","body":"denial -- Review.\n(1) Notwithstanding any provision of KRS 156.161 to the contrary, the Kentucky\nBoard of Education shall establish and maintain a list of expedited waivers  that a\nlocal board of education may submit to the commissioner of education for approval.\nThe list of expedited waivers shall include a waiver of all statutes and\nadministrative regulations that prohibit a district from entering into an agreement\nwith an education service provider to assist in the management and operation of a\nschool or program. The waiver authority delegated to the commissioner of\neducation by the state board shall be subject to the same limitations established in\nKRS 156.161(1).\n(2) The commissioner shall consider an expedited waiver submitted under subsection\n(1) of this section and shall either approve or deny the request within ten (10)\nbusiness days. The commissioner shall approve the request unless he or she\ndetermines that the expedited waiver would substantially:\n(a) Hinder the operation of the district's schools or programs that are the subject\nof the waiver; or\n(b) Impede student academic achievement within the schools or programs that are\nthe subject of the waiver.\n(3) An expedited waiver granted by the commissioner shall expire on June 30 of the\nthird full school year after the request was first approved, regardless of subsequent\namendment, unless the commissioner renews the waiver prior to expiration. The\nstate board may extend the duration of specific expedited waivers on the list for a\nlonger time or permanently.\n(4) If the commissioner at any time finds that a specific expedited waiver previously\ngranted under this section has substantially hindered school or program operation s,\nendangered students, impeded student academic achievement, or supported\nfinancial malfeasance or criminal activity, then the waiver shall be rescinded. The\nexistence of a waiver shall not negate the legal duties or professional\nresponsibilities of district employees.\n(5) A local board may appeal the denial of an expedited waiver by the commissioner to\nthe state board. To be considered by the state board, the appeal shall be filed within\nthirty (30) days of the denial. The state board shall consider the a ppeal within thirty\n(30) days of the appeal being filed.\n(6) By July 1 of each year, the Kentucky Board of Education shall annually review the\nnumbers and types of expedited waivers approved under this section and waivers\ngranted under KRS 156.161 to deter mine if any amendments to or repeals of\nadministrative regulations are necessary. The review shall also include the\noperation of schools of innovation under KRS 156.161. The state board may also\nrecommend statutory changes to the General Assembly to reduce  unnecessary\nburdens on school districts and any new best practices observed from schools of\ninnovation that would benefit schools across the Commonwealth.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58085","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:59Z","sha256":"70c0341a791544f3954a3e332889a923e009250b12de3468424a58b3f31df66c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.161","next":"us-ky/krs-156.1613"},"notice":"GroundRules: Original legal text.
