{"data":{"id":"us-ky/krs-156.483","jurisdiction":"us-ky","citation":"KRS 156.483","heading":"Restrictions on employing violent offenders or persons convicted of sex","body":"crimes -- Criminal record check on job applicants.\n(1) The State Department of Education shall not employ, in a position which involves\nsupervisory or disciplinary power over a mi nor, any person who is a violent\noffender or has been convicted of a sex crime defined in KRS 17.165 as a felony.\nThe Department of Education may employ, at its discretion, persons convicted of\nsex crimes classified as a misdemeanor. The Department of Educ ation shall request\nall conviction information for any applicant for employment from the Justice and\nPublic Safety Cabinet prior to employing the applicant.\n(2) Each application form, provided by the Department of Education to the applicant,\nshall conspicu ously state the following: \"FOR THIS TYPE OF EMPLOYMENT,\nSTATE LAW REQUIRES A CRIMINAL RECORD CHECK AS A CONDITION\nOF EMPLOYMENT.\"\n(3) Any request for records under subsection (1) of this section shall be on a form\napproved by the Justice and Public Safety Cabinet, and the cabinet may charge a fee\nto be paid by the applicant in an amount no greater than the actual cost of\nprocessing the request.\n(4) The provisions of this section shall apply after July 15, 1988, to all applicants for\ninitial employment in a  position which involves supervisory or disciplinary power\nover a minor.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3201","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:00Z","sha256":"c74ac569b86abdb814dea02ae88526527022425863801e3ffaf788b92efe33b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.480","next":"us-ky/krs-156.485"},"notice":"GroundRules: Original legal text.
