{"data":{"id":"us-ky/krs-156.501","jurisdiction":"us-ky","citation":"KRS 156.501","heading":"Student health services -- Responsibilities of Department of Education and","body":"Department for Public Health -- Filling of position.\n(1) The Department of Education shall provide leadership and assistance to local\nschool districts relating to stud ent health services. The department, working in\ncooperation with the Department for Public Health, shall provide, contract for\nservices, or identify resources to improve student health services, including but not\nlimited to the following:\n(a) Standardized protocols and guidelines for health procedures to be performed\nby health professionals and school personnel. The protocols and guidelines\nshall include but not be limited to the following:\n1. The delegation of nursing functions consistent with administrati ve\nregulations promulgated by the Kentucky Board of Nursing;\n2. Training of designated nonmedical school personnel; and\n3. Appropriate documentation and recordkeeping including, but not limited\nto, notification to school administrators and parents or guard ians of the\nprovision of health services by a school employee, including\ncertification of medical necessity for health services signed by a health\ncare professional, and informed consent for the provision of health\nservices by a parent or guardian.\nA copy of the protocols and guidelines shall be made available to each school\nin the Commonwealth and shall be maintained by each school in the school's\nlibrary;\n(b) Consultation, technical assistance, and development of quality improvement\nmeasures for the stat e and local boards of education, individual public\nschools, and local health departments;\n(c) Facilitation of statewide and local data collection and reporting of school\nhealth services; and\n(d) Information and resources that relate to the provision of school health\nservices.\n(2) The Department of Education shall establish a position to assist in carrying out the\nresponsibilities required under subsection (1) of this section.
