{"data":{"id":"us-ky/krs-156.557","jurisdiction":"us-ky","citation":"KRS 156.557","heading":"Definitions -- Statewide framework for teaching -- District personnel","body":"evaluation system -- Summative evaluations -- Appeals -- Prohibition against\ndisclosure of confidential information -- Limits on reporting of evaluation\nresults.\n(1) As used in this section:\n(a) \"Formative evaluation\" means a continuous cycle of collecting evaluation\ninformation and providing feedback with suggestions regarding the certified\nemployee's professional growth and performance; and\n(b) \"Summative evaluation\" means  the summary of, and conclusions from, the\nevaluation data, including formative evaluation data that:\n1. Occur at the end of an evaluation cycle; and\n2. Include a conference between the evaluator and the evaluated certified\nemployee and a written evaluation report.\n(2) The Kentucky Department of Education, in consultation with the Kentucky teacher\nand principal steering committees and other groups deemed appropriate by the\ncommissioner of education, shall develop a statewide framework for teaching that\nshall promote the continuous professional growth and development of skills needed\nto be a highly effective teacher or a highly effective administrator in a school or\ndistrict.\n(3) Each district shall develop and implement a personnel evaluation system aligned\nwith the statewide framework for teaching established in subsection (2) of this\nsection that shall:\n(a) Use multiple measures of effectiveness;\n(b) Include both formative and summative evaluation components;\n(c) Measure professional effectiveness;\n(d) Support professional growth;\n(e) Have at least four (4) performance levels;\n(f) Be used to inform personnel decisions;\n(g) Be considerate of the time re quirements of evaluators at the local level and\nshall not require that all certified school personnel have a formal summative\nevaluation each year; and\n(h) Rate teachers or administrators by multiple measures instead of a single\nmeasure.\n(4) The performance criteria by which teachers and administrators shall be evaluated\nshall include but not be limited to:\n(a) Performance of professional responsibilities related to his or her assignment,\nincluding attendance and punctuality and evaluating results;\n(b) Demonstration of effective planning of curricula, classroom instruction, and\nclassroom management, based on research -based instructional practices, or\nschool management skills based on validated managerial practices;\n(c) Demonstration of knowledge and understa nding of subject matter content or\nadministrative functions and effective leadership techniques;\n(d) Promotion and incorporation of instructional strategies or management\ntechniques that are fair and respect diversity and individual differences;\n(e) Demonstration of effective interpersonal, communication, and collaboration\nskills among peers, students, parents, and others;\n(f) Performance of duties consistent with the goals for Kentucky students and\nmission of the school, the local community, laws, and admi nistrative\nregulations;\n(g) Demonstration of the effective use of resources, including technology;\n(h) Demonstration of professional growth;\n(i) Adherence to the professional code of ethics; and\n(j) Attainment of the teacher standards or the administrator standards as\nestablished by the Education Professional Standards Board that are not\nreferenced in paragraphs (a) to (i) of this subsection.\n(5) The following provisions shall apply to each school district's personnel evaluation\nsystem:\n(a) Certified school  personnel, below the level of superintendent, shall be\nevaluated;\n(b) The evaluation system shall include formative evaluation and summative\nevaluation components; and\n(c) The Kentucky Board of Education shall adopt administrative regulations\nincorporating written guidelines for a local school district to follow in\nimplementing the personnel evaluation system and shall require the following:\n1. All evaluations of certified school personnel below the level of the\ndistrict superintendent shall be in writing on evaluation forms and under\nevaluation procedures developed by a committee composed of an equal\nnumber of teachers and administrators;\n2. The immediate supervisor of the certified school personnel member\nshall be designated as the primary evaluator. At t he request of a teacher,\nobservations by other teachers trained in the teacher's content area or\ncurriculum content specialists may be incorporated into the formative\nprocess for evaluating teachers;\n3. All monitoring or observation of performance of a cer tified school\npersonnel member shall be conducted openly and with full knowledge of\nthe personnel member;\n4. Evaluators shall be trained, tested, and approved in accordance with\nadministrative regulations adopted by the Kentucky Board of Education\nin the p roper techniques for effectively evaluating certified school\npersonnel. Evaluators shall receive support and resources necessary to\nensure consistent and reliable ratings;\n5. The personnel evaluation system shall include a plan whereby the\nperson evaluated is given assistance for professional growth as a teacher\nor administrator. The system shall also specify the processes to be used\nwhen corrective actions are necessary in relation to the performance of\none's assignment;\n6. The system shall require annual summative evaluations for each teacher\nor other professional who has not attained continuing service status\nunder KRS 161.740 or continuing status under KRS 156.800(7). The\nsystem shall require summative evaluations once every five (5) years for\na teacher or other professional who has attained continuing service\nstatus under KRS 161.740 or continuing status under KRS 156.800(7),\nprincipals, assistant principals, and other certified administrators.\nAdditional summative evaluations may be performed at the discretion of\nthe immediate supervisor of a teacher or other professional based upon a\ncase-by-case analysis of the performance criteria set forth in subsection\n(4) of this section but shall not be imposed as a uniform requirem ent\nacross the system; and\n7. The training requirement for evaluators contained in subparagraph 4. of\nthis paragraph shall not apply to district board of education members.\n(6) (a) Each superintendent shall be evaluated according to a policy and procedures\ndeveloped by the local board of education and approved by the department.\n(b) The summative evaluation of the superintendent shall be in writing, discussed\nand adopted in an open meeting of the board and reflected in the minutes, and\nmade available to the public upon request.\n(c) Any preliminary discussions relating to the evaluation of the superintendent\nby the board or between the board and the superintendent prior to the\nsummative evaluation shall be conducted in closed session.\n(7) The Kentucky Board of Education shall establish an appeals procedure for certified\nschool personnel who believe that the local school district failed to properly\nimplement the evaluation system. The appeals procedure shall not involve requests\nfrom individual certified school  personnel members for review of the judgmental\nconclusions of their personnel evaluations.\n(8) The local board of education shall establish an evaluation appeals panel for certified\nschool personnel that shall consist of two (2) members elected by the cer tified\nemployees of the local district and one (1) member appointed by the board of\neducation who is a certified employee of the local board of education. Certified\nschool personnel who think they were not fairly evaluated may submit an appeal to\nthe panel for a timely review of their evaluation.\n(9) The Kentucky Department of Education may annually provide for on -site visits by\ntrained personnel to review and ensure appropriate implementation of the\nevaluation system by the local school district. The depar tment shall provide\ntechnical assistance to local districts to eliminate deficiencies and to improve the\neffectiveness of the evaluation system.\n(10) The disclosure, pursuant to KRS Chapter 61, of any data or information, including\nstudent growth data, tha t local school districts or the Kentucky Department of\nEducation collect on individual classroom teachers under this section is prohibited.\n(11) The results of evaluations conducted under this section shall not be included in the\naccountability system desc ribed in KRS 158.6455 and no reporting requirements\nrelated to these results shall be imposed upon the local school districts by the\nKentucky Department of Education.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56506","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:00Z","sha256":"3d71ca95adf4c15ed3ec3b720bd2a6b5a2631ad5d6865031e8e94d35ee7e55bc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.555","next":"us-ky/krs-156.560"},"notice":"GroundRules: Original legal text.
