{"data":{"id":"us-ky/krs-156.802","jurisdiction":"us-ky","citation":"KRS 156.802","heading":"Office of Career and Technical Education -- Kentucky Board of","body":"Education.\n(1) The Office of Career and Technical Education is hereby created within the\nDepartment of Education. The office shall consist of those administrative bodies\nand empl oyees provided by or appointed by the commissioner of education\npursuant to KRS 156.010.\n(2) The commissioner of education may appoint an assistant, pursuant to KRS 156.010,\nand delegate authority to the assistant regarding the Office of Career and Technic al\nEducation.\n(3) The Department of Education shall have the responsibility for all administrative\nfunctions of the state in relation to the management, control, and operation of:\n(a) State-operated secondary area vocational education and technology center s.\nWhen appropriate, the Department of Education shall provide education\ntraining programs through contracts with private business and industries.\nThese programs may be on a shared cost basis or on a total cost recovery\nbasis; and\n(b) The Carol Martin Gatt on Kentucky FFA Leadership Training Center located\nin Hardinsburg, Kentucky.\n(4) The commissioner of education shall have the authority to enter into agreements or\ncontracts with other government or education agencies, including local school\ndistricts, in order to carry out services under the office's jurisdiction.\n(5) (a) Secondary area vocational education and technology centers shall be operated\nin compliance with program standards established by the Kentucky Board of\nEducation. Principals, counselors, a nd teaching staff shall meet the\nqualifications and certification standards for all secondary vocational\npersonnel as established by the Education Professional Standards Board.\n(b) The Kentucky Board of Education shall be the eligible agency solely\ndesignated for the purpose of developing and approving state plans required\nby state or federal laws and regulations as prerequisites to receiving federal\nfunds for vocational -technical or technology education. The Kentucky Board\nof Education shall involve repres entatives from all eligible recipient\ncategories in the development of the required plans.\n(c) In accordance with 20 U.S.C. sec. 2302(12), the Kentucky Board of Education\nis hereby designated to be the \"eligible agency\" that is the sole state agency\nresponsible for the administration of vocational and technical education and\nthe supervision of the administration of vocational and technical education.\n(6) (a) Except for the duties that the Kentucky Board of Education must retain\npursuant to 20 U.S.C. sec. 2341, the Kentucky Board of Education shall be\nauthorized to delegate all of the other duties and responsibilities of the eligible\nagency to the Office of Career and Technical Education within the\nDepartment of Education, including but not limited to the administration,\noperation, and supervision of the Perkins program and the authority to\nreceive, hold, and disburse funds awarded under the state plan.\n(b) The Kentucky Board of Education shall delegate to the Kentucky Workforce\nInvestment Board the state leadership activities referred to in 20 U.S.C. sec.\n2344 to be conducted in accordance with the req uired and permissible uses of\nfunds specified in the Carl D. Perkins Career and Technical Education Act of\n2006 and subsequent amendments thereto. The maximum amount of funds\nallowed by 20 U.S.C. sec. 2322(a)(2) shall be reserved and made available for\nstate leadership activities.\n(7) The commissioner of education shall be permitted to enter into memorandums of\nagreement with individuals on a year -to-year basis to fill positions in hard -to-find\nteaching specialties. The agreements and compensation for hard -to-find teaching\nspecialties shall be approved by the commissioner of education and shall not be\nsubject to the provisions of KRS Chapter 45A. All agreements shall be filed with\nthe secretary of the Finance and Administration Cabinet.\n(8) The commissioner of education shall, from time to time, prepare or cause to be\nprepared any bulletins, programs, outlines of courses, placards, and courses of study\ndeemed useful in the promotion of the interests of technical and vocational\neducation.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58168","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:01Z","sha256":"905ec529df699e5ba7f0718fc3c3b48d6050f52fc784ae58a504902470e18cc6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.800","next":"us-ky/krs-156.804"},"notice":"GroundRules: Original legal text.
