{"data":{"id":"us-ky/krs-156.814","jurisdiction":"us-ky","citation":"KRS 156.814","heading":"Personnel files.","body":"(1) The records of the Office of Career and Technical Education shall be public records\nand shall be open to public inspection, as provided in KRS 61.870 to 61.884.\n(2) (a) A personnel file shall be maintained by the Department of Education for each\nemployee. The files maintained by the Department of Education shall be the\nofficial personnel file for the employees.\n(b) Each file shall include but not be limited to the employee's name, address, title\nof positions held, classifications, rates of compensation, and  all changes in\nstatus, including evaluations, promotions, demotions, lay -offs, transfers,\ndisciplinary actions, commendations, and awards. Each file shall contain the\ncomplete record and supporting documentation for each personnel action.\n(c) When an employee is reprimanded for misconduct, other infraction, or failure\nto perform duties in a proper or adequate manner, the supervising employee\ntaking the action shall document the action in detail, and shall provide the\nemployee with a copy of the documentati on. The supervising employee shall\ninform the employee of his or her right to prepare a written response to the\naction taken after the employee has reviewed the written documentation\nprepared by the supervising employee. The employee's response shall be\nattached to the documentation prepared by the supervising employee. The\nsupervising employee shall place a copy of the documentation and response in\nthe employee's personnel file and shall transmit a copy to be placed in the\ncentral office personnel file of the employee. The supervising employee shall\nnotify the employee that copies of the documentation and the response\nprovided for in this subsection have been placed in the employee's personnel\nfiles.\n(3) Upon written request, an employee shall have the righ t to examine his or her\npersonnel file. An employee may comment in writing on any item in the file. The\ncomments shall be made a part of the file and shall be attached to the specific record\nor document to which they pertain.\n(4) No public agency, as defin ed by KRS 61.870, and no officer or employee shall\ndeny, abridge, or impede the exercise of the rights granted in any manner by this\nsection and by KRS 61.878.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42165","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:01Z","sha256":"00b6e18f21ce8032430be7a3bd3055785fb18d5fe81bac78d6558342cafaae17","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.812","next":"us-ky/krs-156.816"},"notice":"GroundRules: Original legal text.
