{"data":{"id":"us-ky/krs-156.826","jurisdiction":"us-ky","citation":"KRS 156.826","heading":"Employment status.","body":"(1) All certified and equivalent employees shall serve a one (1) year probationary\nperiod for renewal of limited status. An employee may be separated from the\nposition or reduced in class during this initial probationary period and shall not have\na right to ap peal except as provided in KRS 156.820. If the employee is separated\nfrom the position, notice in writing shall be received at least ten (10) working days\nprior to separation. A copy of the notification shall be forwarded to the\ncommissioner. Unless the commissioner notifies the employee of separation prior to\nthe end of the initial probationary period, the employee shall be eligible for\nrenewable limited status. Limited status employees are subject to reemployment on\nan annual basis. Limited status employe es may be dismissed without cause before\nthe annual anniversary date.\n(2) After completion of the initial probationary period, the individual shall be\nconsidered on limited status until successful completion of the fourth year, at which\ntime the employee may be placed on continuing status.\n(3) An employee who has been assigned continuing status may not be demoted,\ndisciplined, or dismissed without cause except as provided by provisions in KRS\n156.800 to 156.860.\n(4) An employee with continuing status who ha s been promoted shall serve a\nprobationary period of one (1) year in the new position. During the period of\npromotional probation, the employee shall retain the rights and privileges granted\nby the provisions of KRS 156.800 to 156.860 to continuing status employees.\n(5) During the promotional probationary period, the employee with continuing status\nmay be reverted at the discretion of the appointing authority to a position in the\nclass formerly held.\n(6) A continuing status employee who has been laid -off may return to a position with\ncontinuing status if an appropriate position is available.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42177","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:01Z","sha256":"62993ce9b426268fcbb1322a99164564f272824895a9433d2c64b6a3f3efa6ea","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.824","next":"us-ky/krs-156.828"},"notice":"GroundRules: Original legal text.
