{"data":{"id":"us-ky/krs-156.832","jurisdiction":"us-ky","citation":"KRS 156.832","heading":"Procedures for lay-offs.","body":"(1) A lay -off of an employee with continuing status in the Office of Career and\nTechnical Education due to the abolition of a position, lack of funds, or economic\nor employment trends resulting in a lack of work or a material change in duties or\norganization shall comply with the provisions of this section.\n(2) Prior to the notification of lay -off and prior to the lay -off of an employee, the\nDepartment of Education shall prepare a lay -off plan. The plan shall contain the\nname of the employee and the reasons, in  detail, for the lay -off. Upon approval of\nthe plan by the appointing authority or designee, the employee shall be notified of\nthe pending lay-off, and of:\n(a) The reason for the lay-off;\n(b) The procedures established by the provisions of KRS 156.830 and this section\nfor the lay-off of employees; and\n(c) The rights granted employees subject to lay-off and to laid-off employees.\n(3) (a) An employee subject to lay -off shall be considered for a vacant position\nwithin the office of the same pay grade, level of duties, and responsibilities for\nwhich the employee is qualified.\n(b) If a vacancy does not exist, the employee shall be considered for any vacant\nposition within his office for which qualifications are held.\n(4) If no position is available to an employee  subject to lay -off under the procedure\nestablished by subsection (3) of this section, the employee shall be notified of the\nlayoff in writing at least thirty (30) days prior to implementation of the lay-off.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42183","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:01Z","sha256":"71f0fa1634d31d7c642c970f9e4236549b73146d762b616ab26912cc190164d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.830","next":"us-ky/krs-156.834"},"notice":"GroundRules: Original legal text.
