{"data":{"id":"us-ky/krs-156.840","jurisdiction":"us-ky","citation":"KRS 156.840","heading":"Kentucky Technical Education Personnel Board.","body":"(1) The Kentucky Technical Education Personnel Board is hereby established to\nconduct personnel appeals from certified and equivalent employees in the Office of\nCareer and Technical Education under KRS 156.800 to 156.860. Appeals shall be\nconducted in accordance with the provisions established in KRS Chapter 13B. The\nboard shall be attached to the Department of Education for administrative purposes.\n(2) The Kentucky Technical Education Personnel Board shall be composed of five (5)\nvoting members, three (3) of w hom shall be selected from employees within the\nDepartment of Education, except no member shall be an employee within the Office\nof Career and Technical Education. The remaining two (2) members shall be\nteachers employed by the Office of Career and Technic al Education's Area\nTechnology Centers. The election of the teacher representatives may be conducted\nby written ballot, Internet balloting, intranet balloting, or electronic mail. The\nteacher candidates may be present when the balloting is tallied. All vot es cast shall\nbe tallied by an independent entity.\n(a) The Governor shall appoint the two (2) members elected by the teachers\nemployed by the Office of Career and Technical Education's Area Technology\nCenters and the three (3) members selected from employe es within the\nDepartment of Education. All members shall be appointed by the Governor to\nfour (4) year terms, and each term shall end on June 30 of the fourth year.\n(b) Terms of new members or reappointed members shall begin on July 1 of the\nyear beginning their term. If a vacancy occurs during a term, the Governor\nshall appoint a replacement to serve the remainder of the unexpired term\nwithin thirty (30) days of the vacancy. The Governor shall select a\nreplacement from the group where the vacancy occurred.  The manner of\nselection for the replacement shall be the same as the manner of the original\nselection.\n(c) The members shall possess an understanding of the personnel system\nestablished in KRS 156.800 to 156.860.\n(d) A chair shall be elected annually by members of the board.\n(3) The board shall meet as necessary to comply with time frames for conducting\npersonnel appeals under KRS Chapter 13B and KRS 156.800 to 156.860, and at\nother times as deemed necessary by the chair of the board. For meetings of the\nboard, a majority of the voting members shall be present to constitute a quorum for\nthe transaction of business.\n(4) The Office of Career and Technical Education shall provide administrative,\nbudgetary and support staff services for the board.\n(5) Pursuant to KRS 156.010, employees of the Department of Education who serve as\nmembers of the board shall not receive additional salary for serving as members on\nthe board. However, upon approval of the commissioner of education, board\nmembers shall be entitled to reimbursement of actual and necessary expenses\nincurred while performing their duties as an active member of the board.\n(6) During personnel appeals conducted by the board, both parties shall be given the\nopportunity to have a representative present at each step of the process.","path":["KRS Chapter 156"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42191","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:01Z","sha256":"d7161192d18e2daf385dd8a0236d91c3f3e1d35108f9d05ba47dda75b25f3279","source_id":"us-ky","stale":false,"prev":"us-ky/krs-156.838","next":"us-ky/krs-156.842"},"notice":"GroundRules: Original legal text.
