{"data":{"id":"us-ky/krs-157.220","jurisdiction":"us-ky","citation":"KRS 157.220","heading":"Functions of Department of Education in special education programs --","body":"Maximum class size and caseload.\n(1) The Department of Education is hereby designated as the agency for cooperation\nwith the state and federal government agencies, the nonp ublic school programs and\nlocal schools of Kentucky in carrying out the provisions of KRS 157.200 to\n157.290.\n(2) The Kentucky Board of Education shall promulgate necessary administrative\nregulations in accordance with KRS 157.200 to 157.290, including bu t not limited\nto establishment of classes, eligibility and admission of pupils, curriculum, class\nsize and caseload limitations in accordance with subsection (3) of this section,\nhousing, special equipment, and instructional supplies.\n(3) In providing spec ial education services for the exceptional children and youth\nspecified in KRS 157.200(3)(a) to (m):\n(a) The maximum class size for special classes for students with the following\nconditions shall be limited to:\n1. Eight (8) students with autism;\n2. Ten (10) students with a developmental delay;\n3. Eight (8) students with an emotional-behavioral disability;\n4. Ten (10) students with a functional mental disability;\n5. Six (6) students with a hearing impairment;\n6. Fifteen (15) students with a mild mental disability;\n7. Ten (10) students with multiple disabilities;\n8. Sixteen (16) students with an orthopedic impairment;\n9. Sixteen (16) students with an other health impairment;\n10. Ten (10) students in kindergarten to  grade five (5) and fifteen (15)\nstudents in grades six (6) to twelve (12) with a specific learning\ndisability; and\n11. Ten (10) students with a visual disability;\n(b) The maximum caseloads for teachers of special classes shall be as follows:\n1. Fifteen (15) students with autism;\n2. Fifteen (15) students with a developmental delay;\n3. Fifteen (15) students with an emotional-behavioral disability;\n4. Ten (10) students with a functional mental disability;\n5. Eight (8) students with a hearing impairment;\n6. Fifteen (15) students in kindergarten to grade five (5) and twenty (20)\nstudents in grades six (6) to twelve (12) with a mild mental disability;\n7. Ten (10) students with multiple disabilities;\n8. Twenty (20) students with an orthopedic impairment;\n9. Twenty (20) students with an other health impairment;\n10. Fifteen (15) students in kindergarten to grade five (5) and twenty (20)\nstudents in grades six (6) to twelve (12) with a specific learning\ndisability; and\n11. Ten (10) students with a visual disability;\n(c) For speech-language pathologists the caseload limitations in KRS 334A.190\nshall apply;\n(d) Special classes containing more than one (1) disability category shall use the\ncategory of the majority of students in the class to determine the maximum\nclass size established in paragraph (a) of this subsection;\n(e) Two (2) students above the maximum class size established in paragraph (a)\nof this subsection may be added to a class if a paraprofessional is present;\n(f) If a teacher of exceptional children and you th provides services through the\ncollaborative model, the maximum caseload shall not exceed twenty (20)\nstudents in grades six (6) to twelve (12) and fifteen (15) students in\nkindergarten to grade five (5);\n(g) If a teacher of exceptional children and yout h provides services through a\ncombination of collaboration and special classes, the maximum caseload shall\nnot exceed those established in paragraph (b) of this subsection;\n(h) Teachers of special classes who are assigned student records of more than one\n(1) disability category shall use the category of the majority of students on the\ncaseload to determine the maximum caseload established in paragraph (b) of\nthis subsection; and\n(i) State preschool caseload and class size maximums shall be maintained\npursuant to KRS 157.3175.\n(4) The Department of Education is authorized to receive contributions and donations\nthat may be made to carry out KRS 157.200 to 157.290.\n(5) Local supervision of special educational facilities for exceptional children and\nyouth shall be approved by the Department of Education according to\nadministrative regulations promulgated by the Kentucky Board of Education.","path":["KRS Chapter 157"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58159","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:02Z","sha256":"5b9fe1d927dedc400b6b3f758d356c5aaa808a817b6278249292b319f6139b37","source_id":"us-ky","stale":false,"prev":"us-ky/krs-157.210","next":"us-ky/krs-157.221"},"notice":"GroundRules: Original legal text.
