{"data":{"id":"us-ky/krs-158.033","jurisdiction":"us-ky","citation":"KRS 158.033","heading":"Instruction in student's home or hospital -- Signed statement of diagnosed","body":"condition -- Student may receive home or hospital instruction effective on day\nof admittance -- Calculation of instructional sessions for purposes of KRS\n157.360 -- Students with disabilities -- Administrative regulations.\n(1) If in any district there are students not able even with the help of transportation to\nbe assembled in a school, instruction shall be provided to the student in the student's\nhome or in a hospital.\n(2) For a student to be eligible for home or hospital instruction, a signed statement of\nthe diagnosed condition requiring home or hospital instruction shall be provided in\naccordance with KRS 159.030(2).\n(3) For a student admitted to an inpatient fa cility, the student may receive home or\nhospital instruction effective on the day of admittance. Nothing in this subsection\nshall exempt a board of education from the documentation requirements of KRS\n159.030(2)(a).\n(4) For the purposes of KRS 157.360, a s tudent instructed under this section who\nreceives a minimum of two (2) instructional sessions a week with a minimum of\none (1) hour of instruction per session by a certified teacher provided by the board\nof education shall equal the student attending five (5) days in school.\n(5) For students with disabilities, the admissions and release committee shall be\nresponsible for placement decisions regarding home or hospital instruction in\naccordance with the Individuals with Disabilities Education Act, 20 U.S.C. s ec.\n1400 et seq. The home or hospital instruction shall be provided pursuant to the\nindividual education program as determined by the admissions and release\ncommittee. For the purposes of KRS 157.360, students receiving home or hospital\ninstruction under t his subsection may be counted in attendance in accordance with\nsubsection (4) of this section.\n(6) The Kentucky Board of Education shall promulgate administrative regulations to\nestablish the components of home or hospital instruction.\n(7) An instructional session may be delivered in person, electronically, or through other\nmeans established in regulation.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56128","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:03Z","sha256":"ae3c075387b1337807fb41815a9dfa01c22fd37091433ff40747c960ceebd449","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.032","next":"us-ky/krs-158.035"},"notice":"GroundRules: Original legal text.
