{"data":{"id":"us-ky/krs-158.060","jurisdiction":"us-ky","citation":"KRS 158.060","heading":"Access to teacher employment contract -- School month and school day --","body":"Duty-free lunch period -- Nonteaching time for teachers.\n(1) Each teacher shall be provided access to a copy of his or her employment contract\nupon request.\n(2) Twenty (20) school days, or days in which teachers are actually employed in the\nschoolroom, shall constitute a school month in the common schools.\n(3) Each full -time teacher shall be provided with a duty -free lunch period each day\nduring the regularly scheduled stu dent lunch period. The duty -free lunch period\nshall be not less than the length of the lunch period specified in the school calendar\napproved by the chief state school officer. A full -time teacher may be assigned to\nlunch room duty during the regularly sch eduled student lunch period only for an\namount of time equal to the noninstructional time in excess of fifty -five (55)\nminutes included in the teacher's daily schedule. The calculation of noninstructional\ntime shall not include the teacher's duty -free lunc h period, the time teachers are\nrequired to be at school prior to the start of the student's instructional day, or the\ntime teachers are required to remain at school after the students are dismissed.\n(4) Except for children with disabilities and children a ttending the primary school\nprogram who may attend a program of less than six (6) hours per day under policy\nadopted by the local school district board of education and approved by the\ncommissioner of education and children attending a school district wher e the local\nboard has approved a schedule that provides at least the equivalent of six (6) hours\nof daily instruction during the school year, a minimum of six (6) hours of actual\nschool work shall constitute a school day. Kindergarten programs may be opera ted\nfor less than six (6) hours without state board approval. The Kentucky Board of\nEducation, upon recommendation of the chief state school officer, shall develop and\napprove regulations governing make up by school districts of whole days missed\ndue to em ergencies, or partial days missed as a result of shortening regularly\nscheduled school days due to emergencies.\n(5) Teachers shall be provided additional time for nonteaching activities. The\nnonteaching time shall be used to provide teachers opportunities for professional\ndevelopment activities as provided in KRS 156.095, instructional planning, school -\nbased decision making as provided in KRS 160.345, curriculum development, and\noutreach activities involving their students' families and the community.\n(6) Character education programs and activities shall be considered valuable and\nlegitimate components of the actual school work constituting a school day under\nsubsection (4) of this section.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56507","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:03Z","sha256":"dc39c92ef699ee54e9a598a10e25ebeae6c2a12607c9b8af51281b32446cf654","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.050","next":"us-ky/krs-158.065"},"notice":"GroundRules: Original legal text.
