{"data":{"id":"us-ky/krs-158.072","jurisdiction":"us-ky","citation":"KRS 158.072","heading":"Eligible students -- Change of residence within district -- Option to remain","body":"enrolled in original school -- Transportation.\n(1) For purposes of this section, \"eligible student\" shall mean a public school student\nenrolled in kindergarten or grade one (1), two (2), or three (3) who qualifies for free\nor reduced-price school meals or attends a school that participates in the community\neligibility provision of the National School Lunch Program.\n(2) When an eligible student changes his or her resid ence during the school year and\nthe change in residence results in the student being assigned to a different school\nwithin the same school district, the parent or guardian of the eligible student shall\nhave the option to request the student, and any of the  student's siblings enrolled in\nthe same school in any grade, remain enrolled in the original school, regardless of\nthe transportation decision made under subsection (3) of this section.\n(3) (a) Notwithstanding KRS 158.110, if the student remains enrolled in the original\nschool, the school district shall provide transportation to the original school\nfrom the student's new residence, except as provided in paragraph (b) of this\nsubsection.\n(b) The superintendent may deny the transportation request if he or sh e\ndetermines the distance and travel time that the student would spend in\ntransport is impracticable.
