{"data":{"id":"us-ky/krs-158.100","jurisdiction":"us-ky","citation":"KRS 158.100","heading":"Program required to be provided by school district -- Additional programs","body":"permitted -- Refugee or legal alien students -- Virtual high school completion\nprogram -- School district may establish virtual programs.\n(1) Notwithstanding any stat ute to the contrary, each school district shall provide an\napproved preschool school program through twelve (12) grade school service. An\napproved preschool school program through eight (8) grade school service shall be\nprovided for the children residing i n the district by maintaining schools. An\napproved high school service for all children of high school grade under twenty -one\n(21) years of age residing in the district shall be provided either by maintaining the\nschools within the district or by contract with another district. The board of\neducation of any school district, subject to the approval of the chief state school\nofficer, may establish night schools, industrial schools, and other schools for the\nresidents of the district as it deems advisable.\n(2) A school district may provide an approved high school program to a student who is\na refugee or legal alien until the student graduates or until the end of the school year\nin which the student reached the age of twenty-one (21), whichever occurs first.\n(3) (a) The board of education of any school district may establish a virtual high\nschool completion program for residents of the district of at least twenty -one\n(21) years of age that is designed to allow high school dropouts to complete\nhigh school graduation requirements through the use of virtual instruction.\n(b) A student shall be eligible to enroll in a district's program if the student:\n1. Is a resident of the district;\n2. Is at least twenty-one (21) years of age;\n3. Had previously dropped out of a high school; and\n4. Had earned at least sixteen (16) credits at the time of dropping out.\n(c) Notwithstanding paragraph (b)1. of this subsection, a program may enroll a\nnonresident student if the student otherwise qualifies for enrollment.\n(d) To enroll in a district's program, a student shall provide a notarized transcript\nevidencing any credits earned previously towards graduation that are not from\nthat district.\n(e) To earn a high school diploma through the virtual program, a district shall\nrequire a student to either:\n1. Complete the high school graduation requirements of the district that\nwere or would have been applicable to the student at the time the student\ndropped out of high school; or\n2. Complete the high school graduation requirements of the district in\neffect at the time of enrolling in the virtual program.\n(f) A district may charge a student reasonable tuition and fees for the program.\n(4) A school district may establish a virtual program as defined in KRS 157.320 for\nstudents. The local board of education of the school district that operates a virtual\nprogram shall adopt policies to ad dress a student's failure to complete state -\nmandated assessments, including but not limited to kindergarten readiness screeners\nor assessments required under KRS 158.6453.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55953","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:03Z","sha256":"9457eb45e244a16d471b8f02707e06f76fa75ef97310c115a719ac8d840a03a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.090","next":"us-ky/krs-158.102"},"notice":"GroundRules: Original legal text.
