{"data":{"id":"us-ky/krs-158.1415","jurisdiction":"us-ky","citation":"KRS 158.1415","heading":"Curriculum for instruction on human sexuality or sexually transmitted","body":"diseases -- Written consent of parents -- Notification to parents -- Provision of\nalternative curriculum -- Exceptions.\n(1) If a school council or, if none exists, the pri ncipal adopts a curriculum for human\nsexuality or sexually transmitted diseases, instruction shall include but not be\nlimited to the following content:\n(a) Abstinence from sexual activity is the desirable goal for all school -age\nchildren;\n(b) Abstinence from sexual activity is the only certain way to avoid unintended\npregnancy, sexually transmitted diseases, and other associated health\nproblems;\n(c) The best way to avoid sexually transmitted diseases and other associated\nhealth problems is to establish a pe rmanent mutually faithful monogamous\nrelationship;\n(d) A policy to respect parental rights by ensuring that:\n1. Except as provided in subsection (4)(b) of this section, children in grade\nfive (5) and below do not receive any instruction through curriculum or\nprograms on human sexuality or sexually transmitted diseases; or\n2. Any child, regardless of grade level, enrolled in the district does not\nreceive any instruction or presentation that has a goal or purpose of\nstudents studying or exploring gender ident ity, gender expression, or\nsexual orientation; and\n(e) A policy to notify a parent in advance and obtain the parent's written consent\nbefore the parent's child in grade six (6) or above receives any instruction\nthrough curriculum or programs on human sexua lity or sexually transmitted\ndiseases authorized in this section.\n(2) Any course, curriculum, or program offered by a public school on the subject of\nhuman sexuality provided by school personnel or by third parties authorized by the\nschool shall:\n(a) Provide an alternative course, curriculum, or program without any penalty to\nthe student's grade or standing for students whose parents have not provided\nwritten consent as required in subsection (1)(e) of this section;\n(b) Be subject to an inspection by parents of participating students that allows\nparents to review the following materials:\n1. Curriculum;\n2. Instructional materials;\n3. Lesson plans;\n4. Assessments or tests;\n5. Surveys or questionnaires;\n6. Assignments; and\n7. Instructional activities;\n(c) Be developmentally appropriate; and\n(d) Be limited to a curriculum that has been subje ct to the reasonable review and\nresponse by stakeholders in conformity with this subsection and KRS\n160.345(2).\n(3) A public school offering any course, curriculum, or program on the subject of\nhuman sexuality shall provide notification to the parents of a student at least two (2)\nweeks prior to the student's planned participation in the course, curriculum, or\nprogram. The notification shall:\n(a) Inform the parents of the provisions of subsection (2) of this section;\n(b) Provide the date the course, curriculum, or program is scheduled to begin;\n(c) Detail the process for a parent to review the materials outlined in subsection\n(2) of this section;\n(d) Explain the process for a parent to provide written consent for the student's\nparticipation in the course, curriculum, or program; and\n(e) Provide the contact information for the teacher or instructor of the course,\ncurriculum, or program and a school administrator designated with oversight.\n(4) Nothing in this section shall prohibit school personnel from:\n(a) Discussing human sexuality, including the sexuality of any historic person,\ngroup, or public figure, where the discussion provides necessary context in\nrelation to a topic of instruction from a curriculum approved pursuant to KRS\n160.345;\n(b) Providing age -appropriate instruction on child sexual abuse through\ncurriculum or programs in accordance with the standards set forth by the\nNational Children's Alliance and approved by the Children's Advocacy\nCenters of Kentucky, regardless of grade level; or\n(c) Responding to a question from a student during class regarding human\nsexuality as it relates to a topic of instruction from a curriculum approved\npursuant to KRS 160.345.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56524","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:04Z","sha256":"195c9cee30623c6b08089863ced0fb2fce38797b157b3ed853992be2737e0d6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.1413","next":"us-ky/krs-158.142"},"notice":"GroundRules: Original legal text.
