{"data":{"id":"us-ky/krs-158.162","jurisdiction":"us-ky","citation":"KRS 158.162","heading":"Mandatory adoption of emergency management response plan in each","body":"school -- School to maintain portable automated external defibrillators --\nEmergency response drills -- Consequence of schools failing to comply.\n(1) As used in this section:\n(a) \"Emergency management response plan\" or \"emergency plan\" means a\nwritten document to prevent, mitigate, prepare for, respond to, and recover\nfrom emergencies; and\n(b) \"First responders\" means local fire, police, and emergency medical personnel.\n(2) (a) Each local board of education shall require the school council or, if none\nexists, the principal in each school building in its jurisdiction to adopt an\nemergency plan. The emergency plan shall include:\n1. Procedures to be followed in case of medical em ergency, fire, severe\nweather, earthquake, or a building lockdown as defined in KRS\n158.164;\n2. A written cardiac emergency response plan; and\n3. A copy of the data created through the School Mapping Data Program\npursuant to KRS 158.4433 or, if the school mapping data is unavailable,\na diagram of the facility that clearly identifies the location of each\nautomated external defibrillator.\n(b) The emergency plan shall be provided to appropriate first responders and all\nschool staff.\n(c) The emergency plan shall be reviewed following the end of each school year\nby the school nurse, school council, the principal, and first responders and\nrevised as needed.\n(d) The principal shall discuss the emergency plan with all school staff prior to\nthe first instructional day of each school year and document the time and date\nof any discussion.\n(e) The cardiac emergency response plan shall be rehearsed by simulation prior to\nthe beginning of each athletic season by all:\n1. Licensed athletic trainers, school nurses, and athletic directors; and\n2. Interscholastic coaches and volunteer coaches of each athletic team\nactive during that athletic season.\n(f) The emergency plan shall be excluded from the application of KRS 61.870 to\n61.884.\n(3) Each local board of education shall require the school council or, if none exists, the\nprincipal in each school building to:\n(a) Establish primary and secondary evacuation routes  for all rooms located\nwithin the school and shall post the routes in each room by any doorway used\nfor evacuation;\n(b) Identify the best available severe weather safe zones, in consultation with\nlocal and state safety officials and informed by guiding pri nciples set forth by\nthe National Weather Service and the Federal Emergency Management\nAgency, and post the location of safe zones in each room of the school;\n(c) Develop practices for students to follow during an earthquake;\n(d) Develop and adhere to prac tices to control the access to each school building.\nPractices shall include but not be limited to:\n1. Controlling outside access to exterior doors during the school day;\n2. Controlling the main entrance of the school with electronically locking\ndoors, a camera, and an intercom system;\n3. Controlling access to individual classrooms;\n4. Requiring classroom doors to be equipped with hardware that allows the\ndoor to be locked from the outside but opened from the inside;\n5. Requiring classroom doors to remain c losed and locked during\ninstructional time, except:\na. In instances in which only one (1) student and one (1) adult are in\nthe classroom; or\nb. When approved in writing by the state school security marshal;\n6. Requiring classroom doors with windows to be e quipped with material\nto quickly cover the window during a building lockdown;\n7. Allowing for the use of secondary locking mechanisms on classroom\ndoors, notwithstanding any provisions of the Kentucky Building Code\npromulgated pursuant to KRS Chapter 198B to the contrary;\n8. Requiring all visitors to report to the front office of the building, provide\nvalid identification, and state the purpose of the visit; and\n9. Providing a visitor's badge to be visibly displayed on a visitor's outer\ngarment;\n(e) Maintain a portable automated external defibrillator in a public, readily\naccessible, well -marked location in every school building and, as funds\nbecome available, at school -sanctioned athletic practices and competitions\nand:\n1. Adopt procedures for the use of th e portable automated external\ndefibrillator during an emergency;\n2. Adopt policies for compliance with KRS 311.665 to 311.669 on\ntraining, maintenance, notification, and communication with the local\nemergency medical services system;\n3. Ensure that a minimum of three (3) employees in the school and all\ninterscholastic athletic coaches be trained on the use of a portable\nautomated external defibrillator in accordance with KRS 311.667;\n4. Ensure that all interscholastic athletic coaches mai ntain a\ncardiopulmonary resuscitation certification recognized by a national\naccrediting body on heart health; and\n5. No later than November 1 of each school year, submit an annual report\nto the Kentucky Department of Education on:\na. The number and locati on of each portable automated external\ndefibrillator in every school building;\nb. The name, school, and training date of each school district\nemployee and interscholastic athletic coach in the district trained\nin the use of a portable automated external defibrillator; and\nc. The progress made towards having a portable automated external\ndefibrillator at all school -sanctioned athletic practices and\ncompetitions; and\n(f) Require development of an event -specific emergency action plan for each\nschool-sanctioned nonathletic event held off -campus to be used during a\nmedical emergency, which may include the provision of a portable automated\nexternal defibrillator. The plan shall:\n1. Include a delineation of the roles of staff and emergency personnel,\nmethods of com munication, any assigned emergency equipment\nincluding a portable automated external defibrillator, a cardiac\nemergency response plan, and access to and plan for emergency\ntransport; and\n2. Be in writing and distributed to any member of school personnel\nattending the school-sanctioned event in an official capacity.\n(4) All schools shall be in compliance with the provisions of subsection (3)(d) of this\nsection.\n(5) (a) Each local board of education shall require the principal in each public school\nbuilding i n its jurisdiction to conduct, at a minimum, emergency response\ndrills to include:\n1. One (1) severe weather drill, one (1) earthquake drill, and one (1)\nlockdown drill within the first thirty (30) instructional days of each\nschool year and again during the month of January; and\n2. The emergency response plan rehearsal by simulation required by\nsubsection (2) of this section and the venue -specific emergency action\nplan rehearsal by simulation required by KRS 160.445(5) prior to the\nbeginning of each athletic season.\n(b) Required fire drills shall be conducted according to administrative regulations\npromulgated by the Department of Housing, Buildings and Construction.\nWhenever possible, first responders shall be invited to observe emergency\nresponse drills.\n(6) No later than November 1 of each school year, a local district superintendent shall\nsend verification to the Kentucky Department of Education that all schools within\nthe district are in compliance with the requirements of this section.\n(7) A district wi th a school not in compliance with the requirements of subsection\n(3)(d) of this section by July 1, 2022, shall not be eligible for approval by the\nKentucky Department of Education for new building construction or expansion in\nthe 2022 -2023 school year and  any subsequent year without verification of\ncompliance, except for facility improvements that specifically address the school\nsafety and security requirements of this section, when deemed necessary for the\nprotection of student or staff health and safety,  or to comply with other legal\nrequirements or orders.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55390","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:04Z","sha256":"7382b0dcdc5bff30b2e8de6af0375271287f68efebf1fc64277afd616d7b1612","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.160","next":"us-ky/krs-158.1621"},"notice":"GroundRules: Original legal text.
