{"data":{"id":"us-ky/krs-158.165","jurisdiction":"us-ky","citation":"KRS 158.165","heading":"Possession and use of personal telecommunications device by public school","body":"student.\n(1) (a) The board of education of each school district shall adopt a policy regarding\nthe possession and use of a personal telecommunications device by a stude nt\nwhile on school property or while attending a school -sponsored or school -\nrelated activity on or off school property, and shall include the policy in the\ndistrict's written standards of student conduct.\n(b) The policy shall, at a minimum, prohibit a stud ent's use of a personal\ntelecommunications device during instructional time, except during an\nemergency, if directed to do so by a teacher for an instructional purpose, or if\nauthorized by a teacher.\n(c) A student who violates the policy shall be subject t o discipline as provided by\nboard policy.\n(2) As used in this section, \"personal telecommunications device\":\n(a) Means a device that emits an audible signal, vibrates, displays a message, or\notherwise summons or delivers a communication to the possessor, i ncluding\nbut not limited to a paging device and a cellular telephone; and\n(b) Does not include any device a student is authorized to use pursuant to the\nIndividuals with Disabilities Education Act, 20 U.S.C. sec. 1400 et seq., the\nAmericans with Disabiliti es Act, 42 U.S.C. sec. 12101 et seq., or the\nRehabilitation Act of 1973, 29 U.S.C. sec. 701 et seq., or successor acts.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56309","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:04Z","sha256":"bac74c4b8685b1056e55f8f665bbda1073c746524e8416054fed5ece2d6690a2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.164","next":"us-ky/krs-158.170"},"notice":"GroundRules: Original legal text.
