{"data":{"id":"us-ky/krs-158.189","jurisdiction":"us-ky","citation":"KRS 158.189","heading":"Legislative findings -- Policies for use of restrooms by students of the","body":"opposite biological sex -- Requirements -- Best available accommodation to be\nprovided.\n(1) As used in this section:\n(a) \"Biological sex\" means the physical condition of bei ng male or female, which\nis determined by a person's chromosomes, and is identified at birth by a\nperson's anatomy; and\n(b) \"School\" means a school under the control of a local board of education or a\ncharter school board of directors.\n(2) The General Assembly finds that:\n(a) School personnel have a duty to protect the dignity, health, welfare, and\nprivacy rights of students in their care;\n(b) Children and young adults have natural and normal concerns about privacy\nwhile in various states of undress, and mo st wish for members of the opposite\nbiological sex not to be present in those circumstances;\n(c) Allowing students to use restrooms, locker rooms, or shower rooms that are\nreserved for students of a different biological sex:\n1. Will create a significant po tential for disruption of school activities and\nunsafe conditions; and\n2. Will create potential embarrassment, shame, and psychological injury to\nstudents;\n(d) Parents have a reasonable expectation that schools will not allow minor\nchildren to be viewed in various states of undress by members of the opposite\nbiological sex, nor allow minor children to view members of the opposite sex\nin various states of undress; and\n(e) Schools have a duty to respect and protect the privacy rights of students,\nincluding the right not to be compelled to undress or be unclothed in the\npresence of members of the opposite biological sex.\n(3) Each local board of education or charter s chool board of directors shall, after\nallowing public comment on the issue at an open meeting, adopt policies necessary\nto protect the privacy rights outlined in subsection (2) of this section and enforce\nthis subsection. Those policies shall, at a minimum , not allow students to use\nrestrooms, locker rooms, or shower rooms that are reserved for students of a\ndifferent biological sex.\n(4) (a) A student who asserts to school officials that his or her gender is different\nfrom his or her biological sex and whos e parent or legal guardian provides\nwritten consent to school officials shall be provided with the best available\naccommodation, but that accommodation shall not include the use of school\nrestrooms, locker rooms, or shower rooms designated for use by stude nts of\nthe opposite biological sex while students of the opposite biological sex are\npresent or could be present.\n(b) Acceptable accommodations may include but are not limited to access to\nsingle-stall restrooms or controlled use of faculty bathrooms, lock er rooms, or\nshower rooms.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53553","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:04Z","sha256":"7f8638c6bd3d6ad4885af5f5a5834f2a7413a2569c88399bd96e05a6c1a078ae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.188","next":"us-ky/krs-158.190"},"notice":"GroundRules: Original legal text.
