{"data":{"id":"us-ky/krs-158.282","jurisdiction":"us-ky","citation":"KRS 158.282","heading":"Instruction of all blind students in the use of braille -- Assessment for blind","body":"students in program -- Exceptions.\n(1) The purpose of KRS 156.476, 158.281, 161.051, and this section shall be to assure,\nto the maximum extent possible, that all blind st udents shall be instructed in the use\nof braille.\n(2) The written individualized education program for each exceptional student, as\npromulgated by administrative regulation, shall also include the following\nassessment for blind students:\n(a) A braille skil ls inventory, including an assessment of the student's strengths\nand weaknesses;\n(b) A statement as to whether the use of braille shall be that student's primary\nmode of communication;\n(c) The date on which braille instruction shall begin;\n(d) The length of the period of instruction, and the frequency and duration of each\ninstructional session; and\n(e) The level of competency in braille reading and writing to be achieved, and the\nassessment measures to be used in determining if that level has been achieved.\n(3) Braille instruction and use shall not be required by this section if, during the course\nof developing the blind student's individualized educational program, the members\nof the Administrative Admission and Release Committee as established for this\npurpose, pursuant to administrative regulations, concur that the student shall not be\nrequired to learn to read and write braille. In reaching its decision, the committee\nshall consider the student's reading readiness, functional reading skills, reading\ncomprehension rate and stamina, functional writing skills, communication skills,\neye condition and prognosis, and functional vision and tactile discrimination skills.\nUpon reaching this determination the committee shall write into the individualized\neducation p rogram of a blind student, the factors and evidence considered by the\ncommittee in reaching its decision.\n(4) Nothing in this section shall require the exclusive use of instruction in braille if\nother methods of reading and writing may also be learned by the student.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3486","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:04Z","sha256":"ada22c47b728ebf316a7f608394976b308a1b9c8cfc2e2f9ed21585e58bfa5c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.281","next":"us-ky/krs-158.285"},"notice":"GroundRules: Original legal text.
