{"data":{"id":"us-ky/krs-158.4410","jurisdiction":"us-ky","citation":"KRS 158.4410","heading":"State school security marshal, duties and  responsibilities --","body":"Marshal  appointed  by  and  reporting to the commissioner  of the\nDepartment  of Criminal Justice Training -- Annual report to the Center for\nSchool  Safety, the Legislative Research Commission,  and the Kentucky\nBoard  of Education -- School security risk assessment  tool, purpose --\nAreas  considered when  evaluating school security -- Annual verification\nof completion of state security risk assessment  -- Additional mandatory\ntraining, when required.\n(1) There is established within the Department of Criminal Justice Training the\noffice of the state school security marshal. The state school security marshal\nshall enhance school safety by monitoring school safety and security initiatives,\ndeveloping reasonable training and other guidelines, developing a school\nsecurity risk assessment tool pursuant to subsection (5) of this section, and\nensuring compliance with the provisions of subsection (7) of this section and\nKRS  158.162(3).\n(2) The office of the state school security marshal shall conduct on-site reviews to\nensure compliance with subsection (7) of this section and KRS  158.162(3) as\ndeemed  necessary by the state school security marshal.\n(3) The  state school security marshal shall be appointed by and report to the\ncommissioner of the Department of Criminal Justice Training.\n(4) By September 1 of each year the state school security marshal shall present\nan  annual report to the board of the Center for School Safety which shall\nconsist of a summary of the findings and recommendations made regarding the\nschool safety and security activity of the previous school year and other items\nof  significance as determined by the Center for School Safety or the\nDepartment of Criminal Justice Training. Once  presented, the annual report\ninformation shall also be submitted to the Legislative Research Commission\nand the Kentucky Board of Education.\n(5) By July 1, 2020, the state school security marshal shall develop and update as\nnecessary a school security risk assessment tool in collaboration with the\nCenter for School Safety and the Kentucky Department of Education to be\nused by local school districts to identify threats, vulnerabilities, and appropriate\nsafety controls for each school within the district. The tool shall be approved by\nthe board of directors of the Center for School Safety pursuant to KRS\n158.443(9)(b) and used by local school administrators when  completing a\nschool security risk assessment in accordance with this section.\n(6) The  assessment tool shall enable administrators to evaluate school security\ncompared  to best practices and standards in a minimum of the following areas:\n(a) School emergency and crisis preparedness planning;\n(b) Security, crime, and violence prevention policies and procedures;\n(c) Physical security measures;\n(d) Professional development training needs;\n(e) Support service roles in school safety, security, and emergency and crisis\npreparedness planning;\n(f) School  resource officer staffing, operational practices, and  related\nservices;\n(g) School and community collaboration on school security; and\n(h) An  analysis of the cost effectiveness of recommended  physical security\ncontrols.\n(7) No  later than July 15, 2021, and each subsequent year, the local district\nsuperintendent shall send verification to the state school security marshal and\nthe Kentucky Department of Education that all schools within the district have\ncompleted the school security risk assessment for the previous year. School\nsecurity risk assessments shall be excluded from the application of KRS\n61.870 to 61.884 pursuant to KRS 61.878(1)(m).\n(8) Beginning with the 2021-2022 school year and each subsequent year, any\nschool that has not completed a school security risk assessment in the\nprevious year shall be required to provide additional mandatory training as\nestablished by the Department of Criminal Justice Training for all staff\nemployed at the school.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48478","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:05Z","sha256":"597231fd0e7520ee98da3e2e53d32fa48f9a1033e5c1ed0f5023529f668742d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.441","next":"us-ky/krs-158.4412"},"notice":"GroundRules: Original legal text.
