{"data":{"id":"us-ky/krs-158.444","jurisdiction":"us-ky","citation":"KRS 158.444","heading":"Administrative regulations relating to school safety -- Role of Department","body":"of Education to maintain statewide data collection system -- Reportable\nincidents -- Annual statistical reports -- Confidentiality.\n(1) The Kentucky Board of Education shall pr omulgate appropriate administrative\nregulations relating to school safety, student discipline, and related matters.\n(2) The Kentucky Department of Education shall:\n(a) Collaborate with the Center for School Safety in carrying out the center's\nmission;\n(b) Establish and maintain a statewide data collection system by which school\ndistricts shall report by sex, race, and grade level:\n1. a. All incidents of violence and assault against school employees and\nstudents;\nb. All incidents of possession of guns or oth er deadly weapons on\nschool property or at school functions;\nc. All incidents of the possession or use of alcohol, prescription\ndrugs, or controlled substances on school property or at school\nfunctions; and\nd. All incidents in which a student has been disc iplined by the school\nfor a serious incident, including the nature of the discipline, or\ncharged criminally for conduct constituting a violation of any\noffense specified in KRS Chapter 508; KRS 525.070 occurring on\nschool premises, on school -sponsored transportation, or at school\nfunctions; or KRS 525.080;\n2. The number of arrests, the charges, and whether civil damages were\npursued by the injured party;\n3. The number of suspensions, expulsions, and corporal punishments; and\n4. Data required during the assessment process under KRS 158.445; and\n(c) Provide all data collected relating to this subsection to the Center for School\nSafety according to timelines established by the center.\n(3) The Department of Education shall provide th e Office of Education Accountability\nand the Education Assessment and Accountability Review Subcommittee with an\nannual statistical report of the number and types of incidents reported under\nsubsection (2)(b) of this section. The report shall include all m onthly data and\ncumulative data for each reporting year. Reportable incidents shall be grouped in\nthe report in the same manner that the reportable incidents are grouped in\nsubsection (2)(b)1. of this section. Data in the report shall be sorted by individu al\nschool district, then by individual schools within that district, and then by individual\ngrades within each school. The report shall not contain information personally\nidentifying any student. The reporting period shall be for an academic year, and\nshall be delivered no later than August 31 of each year.\n(4) All personally identifiable student data collected pursuant to subsection (2)(b) of\nthis section shall be subject to the confidentiality provisions of the Kentucky Family\nEducation Rights and Privacy  Act, KRS 160.700 to 160.730, and to the federal\nFamily Educational Rights and Privacy Act, 20 U.S.C. sec. 1232g, and its\nimplementing regulations.\n(5) Parents, legal guardians, or other persons exercising custodial control or supervision\nshall have the ri ght to inspect or challenge the personally identifiable student\nrecords as permitted under the Kentucky Family Education Rights and Privacy Act\nand the federal Family Educational Rights and Privacy Act and implementing\nregulations.\n(6) Data collected under  this section on an individual student committing an incident\nreportable under subsection (2)(b)1. of this section shall be placed in the student's\ndisciplinary record.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3519","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:05Z","sha256":"0343e5bf3ce35f2683b4f9f23145912e7ea46c11a7691d16618f8f62d3839e1f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.4433","next":"us-ky/krs-158.445"},"notice":"GroundRules: Original legal text.
