{"data":{"id":"us-ky/krs-158.488","jurisdiction":"us-ky","citation":"KRS 158.488","heading":"Stop arm camera violation notice -- Contents -- Destruction of recorded","body":"images.\n(1) Upon a determination to issue a stop arm camera violation notice, the following\ndocuments shall be sent, either by the law enforcement agency or the school\ndistrict's agent, by first-class mail to the owner of a motor vehicle within thirty (30)\ndays of a stop arm camera violation:\n(a) The stop arm camera violation notice form as described in subsection (2) of\nthis section;\n(b) A copy of the recorded images for the stop arm camera violation; and\n(c)  A signed, sworn statement from a law enforcement officer that, based on\ninspection of the recorded images, the motor vehicle was being operated in\nviolation of KRS 189.370. This statement may be signed electronically  and is\nadmissible in any proceeding challenging a stop arm camera violation.\n(2) The stop arm camera violation notice form shall contain in substance the following\ninformation:\n(a) The name and address of the registered owner of the vehicle;\n(b) A statement that the notice represents a determination that a stop arm camera\nviolation has been committed by the owner of the vehicle and that the\ndetermination shall be final unless contested in accordance with KRS\n158.489;\n(c) The date and time of the violation;\n(d) The location of the violation;\n(e) The amount of the civil penalty imposed and the date by which the civil\npenalty shall be paid;\n(f) Instructions on how to pay the civil penalty to the school district or its\ndesignated agent;\n(g) Information advising the owner as to the manner and time in which the civil\npenalty may be contested; and\n(h) A warning that failure to pay the civil penalty imposed or to contest the matter\nin a timely manner is an admission of liability and shall result in the\nsuspension of the motor vehicle's registration.\n(3) A recorded image produced by a camera monitoring system shall be destroyed:\n(a) No later than thirty -one (31) days from the date the recorded image is\ncaptured if the recorded image does not result in a stop arm camera violation\nnotice form issued under this section; or\n(b) Upon final disposition of the stop arm camera violation if the recorded image\nresults in a stop arm camera violation notice form issued under this section.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57413","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:05Z","sha256":"0d6ed795cb006c641b3da023654cb857458aae90ba022ccf940a2394649fc950","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.487","next":"us-ky/krs-158.489"},"notice":"GroundRules: Original legal text.
