{"data":{"id":"us-ky/krs-158.780","jurisdiction":"us-ky","citation":"KRS 158.780","heading":"Management improvement programs.","body":"(1) The Kentucky Board of Education shall establish a program for voluntary\nmanagement improvement, for involuntary supervision, and for assuming full\ncontrol of a local school district.\n(a) The voluntary improvement program shall assist local districts with t he\ndevelopment of innovative management practices and help them adopt\ncurrently accepted practices.\n(b) If the Kentucky Board of Education believes that a critical lack of efficiency\nor effectiveness in the governance or administration of a local school di strict\nexists, it shall conduct an administrative hearing in compliance with KRS\nChapter 13B. If it is determined that there is a critical lack of efficiency or\neffectiveness in the governance or administration, the state board shall assume\nsufficient supe rvision of the district to ensure that appropriate corrective\naction occurs. Neither the state board, the chief state school officer, nor his\ndesignee shall assume the supervision of the district until an administrative\nhearing has been conducted under KRS Chapter 13B.\n(c) If the Kentucky Board of Education believes that the pattern of a lack of\nefficiency or effectiveness in the governance or administration of a school\ndistrict warrants action, it shall conduct an administrative hearing in\ncompliance with KRS Chapter 13B. If it is determined that the pattern does\nwarrant action, it shall declare the district a \"state assisted district\" or a \"state\nmanaged district\" and the state board shall then assume control of the district\nas set forth in this section and KRS 158.785.\n(2) The Kentucky Board of Education shall adopt necessary administrative regulations\nto carry out the provisions of this section and KRS 158.785, including an\nadministrative regulation to more specifically establish and implement the standards\nfor designation as a \"state assisted district\" and a \"state managed district.\"\n(3) The Kentucky Board of Education may delegate to the chief state school officer the\nauthority it deems necessary to carry out the provisions of this section and KRS\n158.785.
