{"data":{"id":"us-ky/krs-158.834","jurisdiction":"us-ky","citation":"KRS 158.834","heading":"Self -administration of medications by students with documented medical","body":"conditions -- Authorization -- Written statement -- Acknowledgment of\nliability limitation -- Duration of permission.\n(1) The board of each local public school district and th e governing body of each\nprivate and parochial school or school district shall permit the self-administration of\nmedications by a student who has a documented medical condition as defined in\nKRS 158.832 if the student's parent or guardian:\n(a) Provides written authorization for self-administration to the school; and\n(b) Provides a written statement from the student's health care practitioner that the\nstudent has a documented medical condition and has been instructed in self -\nadministration of the student's prescribed medications to treat the documented\nmedical condition. The statement shall also contain the following information:\n1. The name and purpose of the medications;\n2. The prescribed dosage;\n3. The time or times the medications are to be regularly admi nistered and\nunder what additional special circumstances the medications are to be\nadministered; and\n4. The length of time for which the medications are prescribed.\n(2) The statements required in subsection (1) of this section shall be kept on file in the\noffice of the school nurse or school administrator.\n(3) The school district or the governing body of each private and parochial school or\nschool district shall inform the parent or guardian of the student that the school and\nits employees and agents shall incur no liability as a result of any injury sustained\nby the student from the self -administration of his or her medications to treat his or\nher documented medical condition. The parent or guardian of the student shall sign\na statement acknowledging that the school shall incur no liability and the parent or\nguardian shall indemnify and hold harmless the school and its employees against\nany claims relating to the self -administration of medications used to treat his or her\ndocumented medical condition. Nothing in this subsection shall be construed to\nrelieve liability of the school or its employees for negligence.\n(4) The permission for self -administration of medications shall be effective for the\nschool year in which it is granted and shall be renewed each following school year\nupon fulfilling the requirements of subsections (1) to (3) of this section.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56829","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:06Z","sha256":"2b8984b31d94f9740141798843c8996e5097b55b7e71b2a2cae8cfee4ecdbe02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.832","next":"us-ky/krs-158.836"},"notice":"GroundRules: Original legal text.
