{"data":{"id":"us-ky/krs-158.844","jurisdiction":"us-ky","citation":"KRS 158.844","heading":"Mathematics achievement fund -- Creation -- Use and disposition of","body":"moneys  -- Administrative regulations -- Requirements for grant applicants\n-- Department  to provide information to schools and to make  annual\nreport to Interim Joint Committee on Education.\n(1) The  mathematics  achievement  fund  is hereby  created  to  provide\ndevelopmentally appropriate diagnostic assessment and intervention services\nto students, primary through grade 12, to help them reach proficiency in\nmathematics  on  the state assessments  under  KRS  158.6453  and  in\ncompliance with the \"No Child Left Behind Act of 2001,\" 20 U.S.C. secs. 6301\net seq., as required under KRS 158.840.\n(2) The grant funds may be used to support the implementation of diagnostic and\nintervention services in mathematics. The use of funds may include: pay for\nextended time for teachers, released time for teachers to serve as coaches and\nmentors or to carry out other responsibilities needed in the implementation of\nintervention services, payment of substitute teachers needed for the support of\nmathematics  teachers, purchase of materials needed  for modification of\ninstruction, and  other costs associated with diagnostic and  intervention\nservices or to cover other costs deemed  appropriate by the Kentucky Board of\nEducation.\n(3) The fund shall:\n(a) Provide funding for the Center for Mathematics created in KRS  164.525\nand the costs of training selected teachers in the diagnostic assessment\nand intervention skills that are needed to assist struggling students in the\nprimary program and other grade levels;\n(b) Provide renewable, two (2) year local grants to school districts and for\npurposes described in subsection (2) of this section; and\n(c) Provide  operational funding for the  Committee  for Mathematics\nAchievement created in KRS 158.842.\n(4) Any  funds appropriated to the mathematics achievement fund that are\nspecifically designated by the General Assembly to support the Center for\nMathematics shall be appropriated to the Council on Postsecondary Education\nand distributed to the university administering the center, as determined by the\ncouncil under KRS 164.525.\n(5) Any moneys in the fund at the close of a fiscal year shall not lapse but shall be\ncarried forward to be used for the purposes specified in this section.\n(6) Any interest earnings of the fund shall become a part of the fund and shall not\nlapse.\n(7) (a) Any  funds appropriated to the mathematics achievement fund and\nspecifically designated by the General Assembly as funding for grants to\nlocal school districts or to support the Committee  for Mathematics\nAchievement  shall be administered by the Kentucky Department of\nEducation.\n(b) The  Kentucky Board  of Education shall promulgate administrative\nregulations relating to the grants for local school districts based on\nrecommendations from the Committee for Mathematics Achievement, the\nsecretary of the Education and Labor Cabinet, the commissioner of\neducation, and the Center for Mathematics established in KRS  164.525.\nThe administrative regulations shall:\n1. Identify eligibility criteria for grant applicants;\n2. Specify the criteria for acceptable diagnostic assessments and\nintervention programs and coaching and mentoring programs;\n3. Establish the minimum  annual evaluation process for each grant\nrecipient;\n4. Identify the annual data that must be provided from each grant\nrecipient;\n5. Define the application and approval process;\n6. Establish matching fund requirements if deemed  necessary by the\nboard;\n7. Define the obligations for professional development and continuing\neducation for teachers, administrators, and staff of each grant\nrecipient;\n8. Establish the conditions for renewal of a two (2) year grant; and\n9. Specify other conditions necessary to implement the purposes of\nthis section.\n(c) As  part of the application process, the board shall require that a grant\napplicant provide assurances that the following principles will be met if the\napplicant's request for funding is approved:\n1. Mathematics  instruction will be  standards-based and  utilize\nresearch-based practices;\n2. Intervention and support services will supplement, not replace,\nregular classroom instruction; and\n3. Intervention services will be provided to primary program students\nand other students who are at risk of mathematics failure within the\nschool based upon ongoing assessments of their needs.\n(d) If matching funds are required, the school council or, if none exists, the\nprincipal or the superintendent of schools, shall allocate matching funds.\nFunding  for professional development allocated to the school council\nunder KRS  160.345 and for continuing education under KRS  158.070\nmay  be used to provide a portion or all of a school's required match.\n(e) The Department of Education shall make available to schools:\n1. Information from the Center for Mathematics regarding diagnostic\nassessment and intervention programs and coaching and mentoring\nprograms  of proven-practice in meeting the needs  of primary\nstudents and other students who are at risk of failure;\n2. Technical assistance to potential applicants and grant recipients;\n3. A list of professional development providers offering teacher training\nin diagnostic assessment and intervention strategies and coaching\nand mentoring; and\n4. Information from  the  Center  for Mathematics  on  how  to\ncommunicate  to parents effective ways  of interacting with their\nchildren to improve  their mathematics  concepts, skills, and\nunderstanding.\n(f) The  Department of Education shall submit a report to the Interim Joint\nCommittee on Education no later than September 1 of each year outlining\nthe use of grant funds. By  November  1, 2007, the Department of\nEducation with input from the Committee for Mathematics Achievement\nand  the Center for Mathematics shall conduct a  statewide needs\nassessment  of the resources needed in each school to help each child\nachieve proficiency in mathematics by the year 2014 and report to the\nInterim Joint Committee on Education an estimate of the cost and a\nspecific timeline for meeting the goal established by the Commonwealth.","path":["KRS Chapter 158"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52384","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:06Z","sha256":"e9a67b213b94629bf6972c66c8fea1320d8419f7dde5cde6320f93c48c8f1bfa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-158.843","next":"us-ky/krs-158.845"},"notice":"GroundRules: Original legal text.
