{"data":{"id":"us-ky/krs-159.030","jurisdiction":"us-ky","citation":"KRS 159.030","heading":"Exemptions from compulsory attendance.","body":"(1) The board of education of the district in which the child resides shall exempt from\nthe requirement of attendance upon a regular public day school every child of\ncompulsory school age:\n(a) Who is a graduate from an accredited or an approved four (4) year h igh\nschool; or\n(b) Who is enrolled and in regular attendance in a private, parochial, or church\nregular day school. It shall be the duty of each private, parochial, or church\nregular day school to notify the local board of education of those students in\nattendance at the school. If a school declines, for any reason, to notify the\nlocal board of education of those students in attendance, it shall so notify each\nstudent's parent or legal guardian in writing, and it shall then be the duty of\nthe parent or lega l guardian to give proper notice to the local board of\neducation; or\n(c) Who is less than seven (7) years old and is enrolled and in regular attendance\nin a private kindergarten-nursery school; or\n(d) Whose physical or mental condition prevents or renders inadvisable\nattendance at school; or\n(e) Who is enrolled and in regular attendance in private, parochial, or church\nschool programs for exceptional children; or\n(f) Who is enrolled and in regular attendance in a state -supported program for\nexceptional children;\n(g) For purposes of this section, \"church school\" shall mean a school operated as\na ministry of a local church, group of churches, denomination, or association\nof churches on a nonprofit basis.\n(2) (a) Before granting an exemption under subsection (1 )(d) of this section, the\nboard of education of the district in which the child resides shall require\nsubmission to the board of satisfactory evidence in the form of a signed\nstatement of a properly licensed physician, advanced practice registered nurse,\nphysician's assistant, psychologist, psychiatrist, or qualified mental health\nprofessional as defined in KRS 202A.011 responsible for diagnosing and\ntreating the child, stating that the diagnosed condition of the child prevents or\nrenders inadvisable attend ance at school and requires home or hospital\ninstruction. If the condition is mental health related, then the signed statement\nshall be completed by a qualified mental health professional as defined in\nKRS 202A.011. On the basis of such evidence, the local  board of education\nmay exempt the child from compulsory attendance.\n(b) Any child who is excused from school attendance more tha n six (6) months\nshall have two (2) signed statements from a combination of two (2) of the\nprofessional persons in accordance with paragraph (a) of this subsection,\nexcept that this requirement shall not apply to a child whose signed statement\ncertifies th at the student has a chronic physical condition that prevents or\nrenders inadvisable attendance at school and is unlikely to substantially\nimprove within one (1) year.\n(c) Exemptions of any student under the provisions of subsection (1)(d) of this\nsection shall be reviewed annually with the evidence required being updated.\n(3) The Kentucky Board of Education may promulgate administrative regulations to\nestablish the components of compulsory attendance and exemptions.","path":["KRS Chapter 159"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53714","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"5ef69d79e568b35eb88dfb82c1ca9a22f0e76ff811f1678a116508f19b79cd34","source_id":"us-ky","stale":false,"prev":"us-ky/krs-159.020","next":"us-ky/krs-159.035"},"notice":"GroundRules: Original legal text.
