{"data":{"id":"us-ky/krs-159.075","jurisdiction":"us-ky","citation":"KRS 159.075","heading":"Pre -enrollment and preadmission of child whose parent or guardian is","body":"transferred to military installation or is returning to the state after being\nseparated from the military.\n(1) A child of a military family may pre -enroll or participate  in preadmission in a\nschool district if the parent or guardian of the child:\n(a) Is transferred to or is pending transfer to a military installation or to a reserve\ncomponent within the state while on active military duty pursuant to an\nofficial military order; or\n(b) Is returning to the state within one (1) year of being separated from the\nmilitary with an honorable discharge, discharge under honorable conditions,\nor a general discharge under honorable conditions.\n(2) (a) A school district shall accept an  application for enrollment and course\nregistration by electronic means for a child who meets the requirements set\nforth in subsection (1) of this section, including enrollment in a specific\nschool or program within the school district.\n(b) A school district shall not require the parent or guardian of a child who meets\nthe requirements set forth in subsection (1) of this section to appear in person\nfor enrollment or course registration, including enrollment in a specific school\nor program within the school district.\n(3) The parent or guardian of a child who meets the requirements set forth in subsection\n(1) of this section shall provide proof of residence to the school district within ten\n(10) days after the arrival date provided on official documentation. T he parent or\nguardian may use, as proof of residence, military orders or the address of:\n(a) A temporary on-post billeting facility;\n(b) A purchased or leased home or apartment;\n(c) Any federal government housing or off -post military housing, including off -\npost military housing that may be provided through a public -private venture;\nor\n(d) A home under contract to be built.\n(4) A child who utilizes this section shall not, until actual attendance or enrollment in\nthe school district:\n(a) Count for the purposes of average daily attendance as defined in KRS 157.320\nor 157.350; or\n(b) Be included in the state assessment and system pursuant to KRS 158.6453 or\n158.6455.\n(5) To accommodate for temporary housing, if a child utilizes this section to enroll in a\ndistrict, but the residence identified in subsection (3) of this section has not yet\nbecome available, then the district shall allow the child to enroll and begin\nattending the district regardless of the child's temporary residence and subsequently\nbe included in the district's calculation of average daily attendance under KRS\n157.320, for a period of up to one (1) year from the parent's or guardian's reporting -\nfor-duty date or separation d ate before being considered a resident of another\ndistrict.","path":["KRS Chapter 159"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55087","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"d4fcbc2661c676b7ed6e95fce4d8a27c235e07556d7cb4f3e2a9015d7cbdece4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-159.070","next":"us-ky/krs-159.080"},"notice":"GroundRules: Original legal text.
