{"data":{"id":"us-ky/krs-15a.340","jurisdiction":"us-ky","citation":"KRS 15A.340","heading":"Kentucky Agency for Substance Abuse Policy (KY-ASAP) -- Organization","body":"-- Purpose -- Oversight by Office of Drug Control Policy -- Members of KY -\nASAP Board -- Duties of board.\n(1) As used in this section and KRS 15A.342 and 15A.344, \"KY -ASAP\" means th e\nKentucky Agency for Substance Abuse Policy.\n(2) The Office of Drug Control Policy shall administer an endowment from interest\ngenerated through funds appropriated or gifts, donations, or funds received from\nany source. The Office of Drug Control Policy may expend endowment principal, if\nnecessary in its discretion, to carry out the purposes of this section and KRS\n15A.342 and 15A.344. These expenditures from the endowment principal are\nhereby appropriated for this purpose.\n(3) (a) The Office of Drug Control Policy shall oversee the activities specified in this\nsection and KRS 15A.342 and 15A.344 and provide administrative support to\nthe seventeen (17) member KY -ASAP Board, which is created to oversee the\nactivities of KY -ASAP. Membership of the board shall  be appointed by the\nGovernor and shall consist of the following:\n1. One (1) member representing the Kentucky Family Resource Youth\nServices Coalition, or a designee;\n2. One (1) member representing the Kentucky Health Department\nAssociation, or a designee;\n3. The secretary of the Cabinet for Health and Family Services, or\ndesignee;\n4. The secretary of the Justice and Public Safety Cabinet, or a designee;\n5. One (1) member representing the Division of Behavioral Health within\nthe Department for Behavioral He alth, Developmental and Intellectual\nDisabilities, Cabinet for Health and Family Services, or a designee;\n6. The commissioner of the Department for Public Health, Cabinet for\nHealth and Family Services, or a designee;\n7. The commissioner of the Department of Alcoholic Beverage Control, or\na designee;\n8. The commissioner of the Department of Education;\n9. The director of the Administrative Office of the Courts, or a designee;\n10. One (1) member representing the Kentucky Association of Regional\nPrograms, or a designee;\n11. One (1) member representing the Kentucky Heart Association, or a\ndesignee;\n12. One (1) member representing the Kentucky Lung Association, or a\ndesignee;\n13. One ( 1) member representing the Kentucky Cancer Society, or a\ndesignee;\n14. Two (2) members representing local tobacco addiction and substance\nabuse advisory and coordination boards; and\n15. Two (2) members representing private community -based organizations,\nwhether for-profit or nonprofit, with experience in programs involving\nsmoking cessation or prevention or alcohol or substance abuse\nprevention and treatment.\n(b) Members shall serve for a term of four (4) years, may be reappointed, and may\nserve no more tha n two (2) consecutive terms. Members shall not be\ncompensated but shall receive reimbursement for expenses incurred while\nperforming board business.\n(c) The board shall meet at least quarterly. A quorum of nine (9) members shall\nbe required for the transac tion of business. Meetings shall be held at the call\nof the chair, or upon the written request of two (2) members to the chair.\n(d) The board shall:\n1. Oversee deposits and expenditures from the endowment;\n2. Request, in its discretion, an audit relating t o the expenditure of\nendowment funds;\n3. Receive quarterly reports from the commissioner of the Department of\nAlcoholic Beverage Control regarding KY-ASAP's activities;\n4. Progress toward development and implementation of the strategic plan;\n5. Recommend t o KY -ASAP the most efficient means for using public\nfunds to coordinate, supplement, and support high quality and ongoing\nprograms of all public agencies and private service providers related to\nsmoking cessation and prevention and alcohol and substance ab use\nprevention and treatment;\n6. Recommend matters for review and analysis by KY-ASAP; and\n7. Perform other duties as necessary for the oversight of KY-ASAP.\n(4) The Office of Drug Control Policy and KY -ASAP shall promote the\nimplementation of research -based strategies that target Kentucky's youth and adult\npopulations.\n(5) The Office of Drug Control Policy and KY -ASAP shall vigorously pursue the\nphilosophy that tobacco in the hands of Kentucky's youth is a drug abuse problem\nbecause of the addictive qualit ies of nicotine, and because tobacco is the most\nprevalent gateway drug that leads to later and escalated drug and alcohol abuse.","path":["KRS Chapter 15A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40741","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:36Z","sha256":"d6a881040e162189e2602f2844fdc8a7ff3b038f28c59d8be41f3462dd24a5a0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-15a.320","next":"us-ky/krs-15a.342"},"notice":"GroundRules: Original legal text.
