{"data":{"id":"us-ky/krs-16.060","jurisdiction":"us-ky","citation":"KRS 16.060","heading":"Powers and duties of commissioner and officers -- Off-duty police","body":"employment and secondary employment -- Policies.\n(1) It shall be the duty of the commissioner, each officer of the department, and each\nindividual employed as a Trooper R Class or CVE R Class to:\n(a) Detect and prevent crime;\n(b) Apprehend criminals;\n(c) Maintain law and order throughout the state;\n(d) Collect, classify, and maintain information useful for the detection of crime\nand the identification, apprehension, and conviction of criminals; and\n(e) Enforce the criminal, motor vehicle, and traffic laws of the Commonwealth.\n(2) The commissioner, each officer of the department, and each individual employed as\na Trooper R Class or CVE R Class is individually vested with the powers of a peace\nofficer and shall:\n(a) Have in all parts of the state the same powers with respect to criminal matters\nand enforcement of laws as sheriffs, constables granted peace officer powers,\nand police officers in their respective jurisdictions; and\n(b) Possess all the immunities and matters of defense now available or hereafter\nmade available to sheriffs, constables granted peace officer powers, and police\nofficers in any suit brought against them in consequence of acts done in the\ncourse of their employment.\n(3) Any warrant of arrest may be executed by the commissioner, any officer of the\ndepartment, and each individual employed as a Trooper R Class or CVE R Class.\n(4) The commissioner shall allow officers of the department or individuals employed as\na Trooper R Class or CVE R Class to engage in law enforcement -related off-duty\npolice employment and secondary employment that:\n(a) Has been reviewed and approved by the commissioner or his or her designee;\n(b) Does not:\n1. Create a conflict with the officer's or individual's duties as an employee\nof the department;\n2. Reflect unfavorably upon the department or the officer or individual; or\n3. Impair the officer's or individual's performance of departmental duties;\n(c) May include contracts involving:\n1. Public entities;\n2. Projects for which a contractor is providing services to a public entity,\nincluding but not limited to the Transportation Cabinet;\n3. Nonpublic entities that receive state funding; and\n4. Ticketed events where public safety is a concern; and\n(d) Shall not include contracts involving:\n1. Retail establishments;\n2. Weddings or private parties; or\n3. Establishments or businesses that sell alcoholic beverages for  on-site\nconsumption as a regular and primary part of the business enterprise.\n(5) The commissioner shall establish policies and procedures consistent with\nsubsection (4) of this section related to off -duty police employment and secondary\nemployment for officers of the department or individuals employed as a Trooper R\nClass or CVE R Class.","path":["KRS Chapter 16"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57407","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:36Z","sha256":"65107f2c4f708b3ef7d5f7c4f825e1a5459ac7121566598c83ba7489c18acb91","source_id":"us-ky","stale":false,"prev":"us-ky/krs-16.055","next":"us-ky/krs-16.062"},"notice":"GroundRules: Original legal text.
