{"data":{"id":"us-ky/krs-16.070","jurisdiction":"us-ky","citation":"KRS 16.070","heading":"Uniforms, equipment, and facilities.","body":"(1) (a) The commissioner is the head and chief executive officer of the department.\nHe or she shall provide for himself or herself, each officer of the department,\nand each individual employed as a Trooper R Class or CVE R Class, under\nthe provisions of KRS 45A.04 5 to 45A.650, such uniforms, equipment, and\nfacilities, including motor vehicles, necessary to the performance of their\nrespective duties, but all uniforms, equipment, and facilities, including motor\nvehicles, shall remain the property of the Commonwealth.\n(b) The commissioner may sell through the Finance and Administration Cabinet,\nunder the provisions of KRS 45A.045 to 45A.650, such uniforms, equipment,\nand facilities, including motor vehicles, as become unfit for use, and all\nmoneys received shall be pai d into the State Treasury and credited to a\nrevolving fund to be used by the department.\n(2) The commissioner shall keep an inventory and shall charge against each officer and\neach individual employed as a Trooper R Class or CVE R Class the value of all\nproperty of the department issued to him or her, and if it is determined by the\ncommissioner that any loss or destruction of property was due to the carelessness or\nneglect of an officer or an individual employed as a Trooper R Class, then the value\nof the p roperty shall be deducted from the pay of the officer or the individual\nemployed as a Trooper R Class or CVE R Class.\n(3) (a) By agreement with the commissioner of highways of the Commonwealth, the\ncommissioner of the Department of Kentucky State Police ma y provide for\nthe leasing of motor vehicles and accessories thereto, radio facilities and\nequipment, office equipment, and other property or facilities, upon terms and\nconditions and for compensation as provided in the agreement.\n(b) The commissioner of hi ghways and the commissioner of the Department of\nKentucky State Police may further provide, by agreement, for the service and\nrepair at any state garage of motor vehicles or accessories thereto which are\nowned, operated, or rented by the department, upon t erms and conditions and\nfor compensation as provided in the agreement.\n(c) Subject to KRS Chapter 42, the department is authorized, by lease or\npurchase, to acquire, maintain, and operate motor vehicles, and the officers of\nthe department, including the co mmissioner and individuals employed as a\nTrooper R Class or CVE R Class, are authorized and empowered to operate\nthese motor vehicles in the course of their duties, and in carrying out the\npurposes, responsibilities, and functions provided for in KRS 16.01 0 to\n16.170 in both an on-duty or off-duty capacity.\n(4) The commissioner shall establish local headquarters so as to best distribute the\nofficers, individuals employed as a Trooper R Class or CVE R Class, and\nemployees of the department throughout the various sections of the Commonwealth\nwhere they will be most efficient in carrying out the provisions of KRS 16.010 to\n16.199.\n(5) The commissioner shall establish policies and procedures related to the approval\nand use of uniforms, equipment, and facilities,  including motor vehicles, necessary\nin the performance of an officer's or individual's off -duty police employment or\nsecondary employment.","path":["KRS Chapter 16"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57408","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:36Z","sha256":"5778e9e0dd54264439b5ca4b400734b97f064b197e8e1cb9b4d85436bd7493f9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-16.069","next":"us-ky/krs-16.075"},"notice":"GroundRules: Original legal text.
