{"data":{"id":"us-ky/krs-16.175","jurisdiction":"us-ky","citation":"KRS 16.175","heading":"Abduction of children -- Kentucky Amber alert system -- Department to","body":"operate in cooperation with other agencies.\n(1) The Department of Kentucky State Police, in cooperation with the Transportation\nCabinet, the Division of Emergency Management, the Ken tucky Broadcasters\nAssociation, and the Kentucky Press Association, shall operate a system to notify\nthe public when a child has been abducted and the department determines that\npublic notification might aid in the recovery of the child. The system shall b e\nknown as the Kentucky Amber alert system.\n(2) The system shall utilize existing resources, including but not limited to electronic\nhighway signs, the emergency broadcast system, law enforcement communications\nsystems, and local, regional, and statewide media providers.\n(3) No public alert using the system shall be issued unless the department, in\nconsultation with the law enforcement agency in the jurisdiction in which the\nabduction of a minor occurred, has determined:\n(a) That the minor has actually been  abducted or that all available evidence\nstrongly indicates that the minor has been abducted;\n(b) That public notification is the most appropriate method of recovering the child\nin a safe and efficient manner; and\n(c) The geographic area in which the notification shall be made.\n(4) If it is determined by the department that public notification shall be initiated, the\ndepartment shall notify the public and private agencies and organizations which will\nactually provide the notification and shall provide those  organizations and agencies\nwith the information which the department deems necessary.\n(5) All law enforcement agencies in the Commonwealth shall cooperate with the\ndepartment in the provision and dissemination of information regarding any\nabducted minor.\n(6) No law enforcement agency, other than the department, shall activate the\nnotification system specified in this section without the authority of the department.\n(7) The system shall be operated by all agencies of the Commonwealth within existing\nbudgetary appropriations.","path":["KRS Chapter 16"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1111","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:36Z","sha256":"a125fa4db1734af78631510237d2081ca207481671c7f1b8c94eb124d5c32c61","source_id":"us-ky","stale":false,"prev":"us-ky/krs-16.174","next":"us-ky/krs-16.176"},"notice":"GroundRules: Original legal text.
