{"data":{"id":"us-ky/krs-16.185","jurisdiction":"us-ky","citation":"KRS 16.185","heading":"Indemnification of State Police officer sued for act or omission in line of","body":"duty who suffers financial loss -- Construction of indemnification.\n(1) Any officer or individual employed as a Trooper R Class who is sued for any act or\nomission in the line of duty and who has a judgment for monetary damages\nrendered against him or her in his or her individual capacity, and who personally\nsuffers actual financial loss, unreimbursed from any source, by the enforcement and\nsatisfaction of the judgment, includin g any costs or attorney fees awarded pursuant\nthereto, shall be indemnified by the Commonwealth, from funds appropriated to the\nFinance and Administration Cabinet for the payment of judgments, to the extent of\nhis or her actual financial loss.\n(2) The inde mnification shall be contingent upon an express determination by the\ncommissioner that the act or omission which resulted in liability was within the\nscope and course of the officer's or the individual employed as a Trooper R Class's\nemployment and occurre d during the performance of duty and was committed or\nomitted in the good faith belief that the act or omission was lawful and proper.\n(3) If the officer seeking indemnification is the commissioner, the determination\nreferred to in subsection (2) of this section shall be made by the Governor.\n(4) The indemnification shall not be construed to abrogate or limit any privilege,\nimmunity, or matter of defense otherwise available to the officer or individual\nemployed as a Trooper R Class and shall not constitute a waiver of any privilege,\nimmunity, or matter of defense, including the sovereign immunity of the\nCommonwealth.\n(5) The indemnification shall not be the subject of comment, directly or indirectly,\nbefore any jury hearing any cause of action in which an of ficer or individual\nemployed as a Trooper R Class is a party, and any comment before the jury shall\nresult in an immediate mistrial.","path":["KRS Chapter 16"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1113","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:36Z","sha256":"7715907af4cec59df70e8eb567d6f41ab3b304421f7c324c99f0aebd83b3b731","source_id":"us-ky","stale":false,"prev":"us-ky/krs-16.180","next":"us-ky/krs-16.186"},"notice":"GroundRules: Original legal text.
