{"data":{"id":"us-ky/krs-16.191","jurisdiction":"us-ky","citation":"KRS 16.191","heading":"Promotions for positions created under KRS 16.187.","body":"(1) Commercial vehicle enforcement officers shall be promoted according to the terms\nand conditions established by this subsection:\n(a) Promotions to commercial vehicle enforcement sergeant within the\ndepartment shall be on the following terms and conditions:\n1. In order to be eligible for the promotion, the applicant shall have served\nas a commissioned commercial vehicle enforcement officer for at least\nsix (6) years;\n2. Promotions made by the department for this position shall be based upon\nthe applicant's cu mulative score computed from twenty -five percent\n(25%) on personnel performance evaluation, thirty percent (30%) on job\nsimulation examination, and forty -five percent (45%) on a written\nexamination;\n3. A promotional list shall be established and shall rema in valid for one (1)\nyear. The promotional list shall consist of the numerical scores and\nrankings of each applicant as provided by subparagraph 2. of this\nparagraph. Promotions shall be made in consecutive order beginning\nwith the highest numerical rankin g to fill an interim vacancy. If two (2)\nor more applicants receive the same numerical score, the order of\nplacement on the list shall be determined by seniority of service. Upon\nthe determination of a new numerical ranking following a new\nexamination, all previous rankings shall be null and void;\n4. The written examination for the applicant's cumulative score shall be\nprepared and administered by an individual designated by the\ncommissioner. Materials and textbooks for the examination shall be\nselected by the commissioner and his or her staff. At least three (3)\nmonths prior to the examination date, the commissioner shall inform all\napplicants of the exact material and textbooks from which test questions\nwill be taken and the minimum score required to be el igible for\nplacement on the promotional list. The written examination shall be\nadministered to all applicants at the same time and the applicant shall\nreceive his or her numerical score immediately upon completion of the\nwritten examination. An applicant's  numerical score shall remain valid\nfor a period of two (2) years following the date of the examination\nunless the source material used as the basis for the test changes by more\nthan thirty percent (30%), provided the numerical score meets or\nexceeds the minimum score set in subsection (2)(d) of this section;\n5. The job simulation examination shall be evaluated by boards designated\nby the commissioner that shall consist of:\na. The commissioner or his or her designee. The designee shall have\na rank no lower than commercial vehicle enforcement captain;\nb. An officer from another police agency of the rank equal to the\nposition for which the applicant is competing;\nc. An instructor from an accredited law enforcement education\nprogram;\nd. A personnel director from private industry; and\ne. A commercial vehicle enforcement officer of the rank equal to the\nposition for which the applicant is competing;\n6. The designated job simulation examination boards shall perform all\nevaluations under guidelines developed and approved by the\ncommissioner; and\n7. Personnel performance evaluations shall be made by the appropriate\nsupervisory personnel under procedures established and approved by the\ncommissioner;\n(b) Promotions from commercial vehicle enforcement sergeant to commercial\nvehicle enforcement lieutenant within the department shall be on the same\nterms and conditions as promotions to sergeant. In addition, any applicant for\nlieutenant shall have completed at least one (1) year of continuous service in\ngrade as a sergeant;\n(c) Promotions from commercial vehicle enforcement lieutenant to commercial\nvehicle enforcement captain within the department shall be on the same terms\nand conditions as promotions to lieutenant. In addition, any applicant for\ncaptain shall have completed at least one (1) year of continuous service in\ngrade as a lieutenant;\n(d) The department shall develop and administer only one (1) test for e ach of the\nranks established by this subsection. All eligible applicants shall be permitted\nto participate in the promotional process to the next highest position of\nresponsibility wherever a vacancy exists;\n(e) Officers promoted to rank of sergeant, lieut enant, or captain shall serve a\nprobationary period for one (1) year of continuous service from the effective\ndate of their promotions, and may be reverted to their previous rank with or\nwithout cause at any time during this period;\n(f) Promotions to the r ank of commercial vehicle enforcement major are\ntemporary and shall not be subject to the provisions for selection and\npromotion as required by this subsection. All officers in such temporary\npositions shall serve at the pleasure of the commissioner and sh all revert to\ntheir previous permanent rank upon the termination of their temporary\nappointment;\n(g) The total number of supervisory officers of all classifications established by\nthis subsection shall be limited to a ratio not to exceed one (1) supervisor  for\nevery five (5) nonsupervisory officers; and\n(h) No officer of the department, other than temporary positions above the rank of\ncaptain, shall be promoted to the next highest rank without competing with\nother officers as prescribed by the promotional p rocedure established by this\nsubsection.\n(2) Promotions from hazardous devices investigator officer to hazardous devices\nsupervisor shall be on the following terms and conditions:\n(a) The applicant shall have at least seven (7) years of experience involvin g\nexplosives or hazardous devices used in the areas of law enforcement, the\nmilitary, or firefighting;\n(b) The applicant shall hold a current certification as a hazardous devices\ntechnician issued by a national hazardous devices school;\n(c) When there is a single applicant for a position, the applicant shall:\n1. For a written examination, complete and achieve at least a minimum\nscore as determined by the commissioner in consultation with the\nKentucky State Police Promotional Review Board;\n2. For a job simul ation exercise, complete and achieve at least a minimum\nscore as determined by the commissioner in consultation with the\nKentucky State Police Promotional Review Board;\n3. For a personnel performance evaluation, achieve a minimum score as\ndetermined by the commissioner in consultation with the Kentucky State\nPolice Promotional Review Board; and\n4. Submit to an oral interview before a board of supervisory personnel\ndesignated by the commissioner;\n(d) When there are multiple applicants for a position, promoti ons shall be based\nupon a cumulative score computed from twenty -five percent (25%) on\npersonnel performance evaluation, thirty percent (30%) on job simulation\nexamination, and forty-five percent (45%) on a written examination on which\nthe applicant achieve d at least a minimum score as determined by the\ncommissioner in consultation with the Kentucky State Police Promotional\nReview Board. If an applicant is not employed by the department, job\nevaluations from past employers shall substitute for the personnel\nperformance evaluation on a scale established by department's human\nresources branch;\n(e) Personnel performance evaluations shall be made by the appropriate\nsupervisory personnel under procedures established and approved by the\ncommissioner; and\n(f) The commissioner may appoint a hazardous devices supervisor from outside\nof the department if the applicant meets the minimum requirements for\npromotion from hazardous devices investigator to hazardous devices\nsupervisor as provided by this subsection.\n(3) Facilities security officers shall be promoted according to the terms and conditions\nestablished by this subsection:\n(a) Promotions to facilities security sergeant within the department shall be on the\nfollowing terms and conditions:\n1. The applicant shall have  served as either a facilities security officer for\nat least two (2) years or possess at least two (2) years of other law\nenforcement or security services experience;\n2. The applicant shall complete and pass a written examination established\nby the department;\n3. When there are multiple applicants for a position, promotions shall be\nbased upon a cumulative score computed from sixty percent (60%) on\npersonnel performance evaluation and forty percent (40%) on a written\nexamination. If an applicant is not empl oyed by the department, job\nevaluations from past employers shall substitute for the personnel\nperformance evaluation on a scale established by the department's\nhuman resources branch; and\n4. Personnel performance evaluations shall be made by the appropria te\nsupervisory personnel under procedures established and approved by the\ncommissioner; and\n(b) Promotions or appointments to facilities security lieutenant within the\ndepartment shall be on the following terms and conditions:\n1. The applicant shall have served as either a facilities security officer for\nat least three (3) years or possess at least three (3) years of other law\nenforcement or security services experience;\n2. The applicant shall have at least two (2) years previous s upervisory\nexperience in a law enforcement or security services position;\n3. The applicant shall complete and pass a written examination established\nby the department;\n4. When there are multiple applicants for a position, promotions shall be\nbased upon a c umulative score computed from sixty percent (60%) on\npersonnel performance evaluation and forty percent (40%) on a written\nexamination. If an applicant is not employed by the department, job\nevaluations from past employers shall substitute for the personne l\nperformance evaluation on a scale established by the department's\nhuman resources branch; and\n5. Personnel performance evaluations shall be made by the appropriate\nsupervisory personnel under procedures established and approved by the\ncommissioner.\n(4) There shall be no discrimination based on race, sex, age, national origin, color,\nreligion, creed, or political affiliation with respect to the department promotional\nsystem.
