{"data":{"id":"us-ky/krs-160.041","jurisdiction":"us-ky","citation":"KRS 160.041","heading":"Merger of independent district with county district.","body":"(1) When a board of education of an independent school district desires to have its\ndistrict become a part of the county school district, it shall by motion so record its\ndesire in the minutes of the board. The board, or its executive officer, shall convey\nthis request to the county board of education. At its next regular meeting, or at a\nspecial meeting held prior thereto, the county board of education shall pass upon\nthis request.\n(2) If the county board of education refuses, or the two (2) boards of educatio n cannot\nagree upon such a proposition of merger of the independent district with the county\ndistrict, the question of merger shall be submitted to the qualified voters of the two\n(2) districts at the next regular election if the question is filed with the  county clerk\nnot later than the second Tuesday in August preceding the regular election.\n(a) If a majority of those voting on the question favor merger, the school boards\nof the two (2) school districts shall jointly develop a plan for adoption of the\nmerger.\n(b) If the two (2) school boards cannot agree to the terms of merger within sixty\n(60) days following the date of the regular election, the chief state school\nofficer shall develop the terms of the adoption of merger.\n(c) Notwithstanding subsection (2 )(a) of this section, if the independent school\ndistrict cannot meet its current operating expenses from projected revenue and\nif the two (2) school boards cannot agree to the terms of a merger, the\nproposition of merger shall be submitted to the Kentucky Board of Education,\nand the Kentucky Board of Education shall determine whether the two (2)\ndistricts should be merged and if merged the terms thereto.\n(d) Upon completion of the plan for adoption of the merger, whether prepared by\nthe school boards or the  superintendent, it shall become effective and the\nindependent district shall become a part of the county school district as set out\nin the plan.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3661","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"4bb20c4251f9846c4a645fe8df0bcb79e22531639a8826dd6f2012fc7b93a4dd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.040","next":"us-ky/krs-160.042"},"notice":"GroundRules: Original legal text.
