{"data":{"id":"us-ky/krs-160.135","jurisdiction":"us-ky","citation":"KRS 160.135","heading":"Truancy intervention -- Collection and reporting of data -- Requirements -","body":"- Annual report.\n(1) As used in this section:\n(a) \"Complaint\" has the same meaning as in KRS 600.020;\n(b) \"Court-designated worker\" has the same meaning as in KRS 600.020; and\n(c) \"Habitual truant\" has the same meaning as in KRS 159.150(3).\n(2) The purpose of this section is to require the collection and reporting of data that will\naid in the understanding of the impact that various interventions have on the\nattendance of students who are habitually truant.\n(3) Beginning in the 2027 -2028 school year, each school district shall document the\nfollowing information in the state student information system:\n(a) The filing of a complaint for habitual truancy by the school distri ct with the\ncourt-designated worker;\n(b) The resolution of the habitual truancy complaint filed with the court -\ndesignated worker, including the date of the resolution and whether the\ncomplaint was:\n1. Not pursued;\n2. Successfully diverted;\n3. Forwarded to the county attorney for court action; or\n4. Resolved in some other manner;\n(c) The reporting of a student to the county attorney as required by KRS\n159.140(3)(b); and\n(d) When a habitual truancy petition is filed with the court.\n(4) By December 1, 2028, and by December 1 of each year until December 1, 2031, the\nKentucky Department of Education shall submit to the Legislative Research\nCommission for referral to the Interim Joint Committee on Education and the\nInterim Joint Committee on Judiciary an annual report that includes the information\nunder this subsection for the prior school term. The information shall be reported by\nschool district, and within each school district by gender, race, and grade level, and\ncontain the following:\n(a) The number of students reported to the county attorney as required under KRS\n159.140(3)(b);\n(b) The number of students against whom a complaint for habitual truancy is filed\nwith the court-designated worker, and among those children:\n1. The number of unexcused absences per student prior to the filing of the\ncomplaint for habitual truancy;\n2. The number of students placed on diversion by the court -designated\nworker and the number of unexcused absences per student after the\nstudent is placed on diversion;\n3. The number of students who successfully complete diversion and the\nnumber of unexcused absences per student after diversion is completed;\nand\n4. The number of students whose case is referred to court on a habitual\ntruancy complaint, and t he number of unexcused absences per student\nafter the complaint is referred to court; and\n(c) The number of students who are withdrawn from a school district following\nthe report to the county attorney under KRS 159.140(3)(b).","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57481","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"8ba33edc25e99d9b43d2bc74aa2aef36fb6b538a4bb64d2abbfd242719ed7652","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.130","next":"us-ky/krs-160.140"},"notice":"GroundRules: Original legal text.
