{"data":{"id":"us-ky/krs-160.152","jurisdiction":"us-ky","citation":"KRS 160.152","heading":"Kentucky Educator Placement Service System -- Requirements --","body":"Operation -- Annual report.\n(1) As used in this section, \"Kentucky Educator Placement Service System\" or\n\"system\" means the online statewide job posting system operated by the Kentucky\nDepartment of Education for vacancies at, and applications to, local school districts\nand public charter schools.\n(2) The Kentucky Department of Education shall ensure that the Kentucky Educator\nPlacement Service System:\n(a) Is accessible through the department's website;\n(b) Includes a mechanism for local school districts and public charter schools to\nelectronically post job openings on the system as provided in subsection (4) of\nthis section;\n(c) Allows the public to review job postings;\n(d) Allows potential applicants to create one (1) or more universal applications\nand electronically submit applications and relevant application materials to\nmultiple local school districts or public charter schools; and\n(e) Permits school districts and public cha rter schools to access, review, and\ndownload applications and application materials.\n(3) Each job posting for a vacancy at a school district or public charter school shall\ninclude the school district's or public charter school's policy against discriminati on\nin employment.\n(4) School districts and public charter schools shall electronically post all job openings\nto the system. All postings must include an opening and closing date for each\nposition posted.\n(5) The Kentucky Department of Education shall opera te and maintain the system to\nensure that job postings are current, including tracking each unique position posted,\nmonitoring for repeated position postings, and removing outdated postings, and to\ncollect accurate data about employment in public schools.\n(6) Nothing in this section shall:\n(a) Prohibit a school district or public charter school from advertising job\nopenings and recruiting employees independently from the system;\n(b) Prohibit a school district or public charter school from using another meth od\nof advertising job openings or another applicant tracking system in addition to\nthe system;\n(c) Require all job applications for posted vacancies to be submitted digitally or\nonly be submitted through the system; or\n(d) Provide the Kentucky Department o f Education with any regulatory authority\nin the hiring process or hiring decisions of any school district or public charter\nschool.\n(7) The Kentucky Department of Education shall prepare a report detailing data from\nthe system and its implication for the status of employment in public schools,\nincluding but not limited to the number and type of unique and duplicated job\npostings, how often postings are viewed by the public, and positions that are\nremaining vacant by type, certification requirement, and loc ation.
