{"data":{"id":"us-ky/krs-160.1595","jurisdiction":"us-ky","citation":"KRS 160.1595","heading":"Request for technical assistance -- Appeal of approval or denial to state","body":"board -- Judicial review -- Joint oversight.\n(1) Any applicant or board of directors of a public charter school may request technical\nassistance from the Kentucky Depa rtment of Education to address deficiencies\nidentified by an authorizer. The department shall respond within thirty (30) days of\nthe request.\n(2) (a) The state board, upon receipt of a notice of appeal, shall review decisions of\nany other authorizer concer ning the approval or denial of a public charter\nschool application, the nonrenewal or revocation of a public charter school's\ncontract, the denial of a public charter school's request to consider a charter\namendment, or the unilateral imposition of conditi ons in the charter contract,\nin accordance with the provisions of this section.\n(b) A charter applicant or approved public charter school who wishes to appeal a\ndecision of an authorizer concerning a charter application, a charter\namendment, or the nonrene wal or revocation of a charter, or the unilateral\nimposition of conditions, shall provide the state board and the authorizer with\na notice of appeal within thirty (30) days after the authorizer's decision. The\nappellant shall limit the grounds of the appea l to the grounds for the denial of\nor the nonrenewal or revocation of a charter, or the unilateral imposition of\nconditions, whichever is being appealed, specified by the authorizer. The\nnotice shall include a brief statement of the reasons the public char ter school\napplicant or public charter school contends the authorizer's denial of or\nnonrenewal or revocation of a charter, or imposition of conditions was in\nerror.\n(c) If the notice of appeal relates to an authorizer's decision to deny, refuse to\nrenew, or revoke a charter or to an authorizer's unilateral imposition of\nconditions that are unacceptable to the charter applicant or public charter\nschool, the appeal and review process shall be as follows:\n1. Within forty-five (45) days after receipt of the no tice of appeal and after\nreasonable public notice, the state board, at a public hearing which may\nbe held in the school district in which the proposed public charter school\nhas applied for a charter or where the public charter school exists, shall\nreview the decision of the authorizer and make its findings;\n2. The state board shall determine:\na. If the final decision of the authorizer was contrary to the best\ninterest of the students or community; and\nb. If the application failed to satisfy the requirements  of KRS\n160.1593(3) and (4);\n3. If the state board finds that the authorizer's decision was contrary to the\nbest interest of the students or community and the application satisfies\nthe statutory requirements, the state board shall remand such final\ndecision to the authorizer with instructions to approve the charter\napplication or amendment, or to renew or reinstate the charter, or to\napprove or disapprove conditions imposed. The decision of the state\nboard shall be a final action subject to judicial review in the Circuit\nCourt encompassing the school district in which the public charter\nschool is located; and\n4. Charters granted to applicants by authorizers after a successful appeal to\nthe state board, as outlined in subparagraph 3. of this paragraph, shall be\nprovided joint oversight by the authorizer and the state board for, at a\nminimum, the first five (5) years of the school's operation, and until the\nauthorizer, state board, and public charter school agree that charter\noversight may be provided solely by the authorizer. The state board shall\nbe a formal participant in all authorizing decision making concerning the\npublic charter school during that period, and shall be included in all\ncommunication between the public charter school and the authorizer.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53119","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"d64770a2eaba51d850960177758af60603f90fcc946fc843596627c17c09d46b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.1594","next":"us-ky/krs-160.1596"},"notice":"GroundRules: Original legal text.
