{"data":{"id":"us-ky/krs-160.1599","jurisdiction":"us-ky","citation":"KRS 160.1599","heading":"Conversion of public noncharter school to public charter school --","body":"Establishment requirements -- Administrative regulations -- Governance --\nEnrollment requirements -- Employees -- Collective bargaining -- School\nfacilities.\n(1) An existing public school not scheduled for closure may be converted into a public\ncharter school and be identified to become a conversion public charter school if an\napplicant indicates to a valid authorizer the intent to convert an existing public\nschool into a conversion public charter school.\n(2) A conversion public charter school may only be established if:\n(a) A school has been identified by the Kentucky Department of Education as\nperforming in the lowest five percent (5%) of its level and sixty percent (60%)\nof the parents or guardians of students who attend the school have signed a\npetition requesting the conversion, which shall be completed and submitted to\na valid authorizer no later than ninety (90) days after the date of the first\nsignature;\n(b) A school has been identified by the Kentucky Department of Education as not\nperforming in the lowest five percent (5%) of its level and sixty percent (60%)\nof the parents or guardians of students who attend the school have signed a\npetition requesting the conversion, which is approved by a majority vote of the\nlocal school board. If approved the completed petition shall be submitted to a\nvalid authorizer no later than ninety (90) days after the date of the first\nsignature; or\n(c) The local school board votes to convert  an existing public school over which\nit has authority.\n(3) For each conversion option identified in subsection (2) of this section, the Kentucky\nBoard of Education shall promulgate administrative regulations to govern the\nprocesses and procedures for the petition, the conversion, and the operation of a\nconversion public charter school.\n(4) A conversion public charter school shall be governed by a board of directors\nconstituted and empowered as provided in KRS 160.1592.\n(5) A conversion public charter schoo l shall continue to comply with all federal and\nstate requirements concerning the treatment of children with special needs and\naccept all students who attended the school prior to its conversion who wish to\nattend.\n(6) A conversion public charter school shall hire its own employees.\n(7) An employee who works in a conversion public charter school shall be an employee\nof the public charter school.\n(8) (a) For any collective bargaining agreement entered into on or after June 29,\n2017, a governing board shall n ot be bound by its collective bargaining\nagreement for employees of a conversion public charter school.\n(b) Employees of a conversion public charter school may organize and\ncollectively bargain only as a unit separate from other school employees.\n(9) A conversion public charter school shall continue to be housed in the same public\nschool facility and shall have the option of using the existing assets of the school.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53123","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:07Z","sha256":"62c90253d1343e8b73246085a660f53944dccb37b84948ef82b35ec49db5251a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.1598","next":"us-ky/krs-160.160"},"notice":"GroundRules: Original legal text.
