{"data":{"id":"us-ky/krs-160.295","jurisdiction":"us-ky","citation":"KRS 160.295","heading":"Procedure for promulgation of code of student rights and responsibilities","body":"for secondary schools -- Prohibited student activities.\n(1) The board of education of each public school district in the Commonwealth may\nadopt and promulgate a code of student rights and responsibilities for secondary\nschools from recommendations of a committee composed of students, faculty,\nparents, and school district administrative personnel.\n(2) Such committee shall consist of two (2) students, two (2) parents of students, t wo\n(2) faculty members, two (2) representatives from administrative personnel of the\ndistrict, and one (1) member of the local school board.\n(3) The student and faculty members of such committee shall be elected by their peers\nin the local school district;  the administrative personnel shall be appointed by the\nschool district superintendent, and the parents selected by the faculty and student\nbody. Members of such committee shall serve for a term of one (1) year and may be\nreelected or reappointed in follow ing years. Initial composition of the elected\nmembers of such committee shall be by the following:\n(a) The district superintendent shall notify each school within the district, each\nschool principal or head teacher, the students of the district, and the pa rents of\nstudents within the district as to the method for receiving nominations for\nmembership on the committee and of the methods by which the election of\nmembers shall take place. Such notification shall take place on or before the\nfirst day of school for each school term.\n(b) Nominations for the student, faculty, and parent members of the committee\nshall be received in writing by the district superintendent within thirty (30)\ndays following the commencement of each school term.\n(c) The election of student, faculty, and parent members of the committee shall be\nheld within fourteen (14) days following the closing of nominations under the\nsupervision of the district superintendent.\n(d) The initial meeting of the elected and appointed members shall be no lat er\nthan fourteen (14) days following the election.\n(4) Each committee member shall be entitled to a single vote and any code of student\nrights and responsibilities adopted by a majority of the committee membership shall\nbe submitted to the district board of education which may cause such code, in whole\nor in part, to be implemented in the public schools of the district.\n(5) All meetings of the committee shall be open to the public and the committee shall\nhold at least one (1) public hearing on the proposed code before it is adopted and\nsubmitted to the district board of education for implementation.\n(6) The code of student rights and responsibilities adopted by the committee may define\nrights and responsibilities regarding, but not limited to, the following:\n(a) Right of expression, including, but not limited to, appearance, assembly,\nassociation, and circulation of petitions and literature;\n(b) Right to participate in decision-making procedures directly affecting students;\n(c) Right to procedural due process  concerning major disciplinary action, as\ndefined by the code;\n(d) Right to receive academic grades based only upon academic performance;\n(e) Right to freedom from abuse and threat of abuse by members of school\nfaculties and administration personnel; and\n(f) Right of access by a student to his or her own records and guarantee of the\nconfidentiality of a student's academic records outside of the school system,\nexcept upon written authorization of the student or his or her parents or\nguardians.\n(7) Students shall refrain from activity which materially or substantially disrupts the\neducational process or presents a clear and present danger to the health and safety of\npersons or property, or infringes on the rights of others.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3704","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:08Z","sha256":"2f7999949f6f38df112548e9820bfdd2cd0ebe14761319a151c69b4ca907634a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.294","next":"us-ky/krs-160.297"},"notice":"GroundRules: Original legal text.
