{"data":{"id":"us-ky/krs-160.352","jurisdiction":"us-ky","citation":"KRS 160.352","heading":"Screening committee -- Minority representation -- Recommendations for","body":"superintendent.\n(1) For purposes of this section the term \"minority\" means American Indian; Alaskan\nnative; African-American; Hispanic, including persons of Mexican, Puerto Rican,\nCuban, and Central or South American origin; Pacific islander; or other ethnic\ngroup underrepresented in a local school district.\n(2) Each board of education shall appoint a superintendent of schools after receiving\nthe recommendations of a screening commit tee. A screening committee shall be\nestablished within thirty (30) days of a determination by a board of education that a\nvacancy has occurred or will occur in the office of superintendent, except that when\nthe board determines a vacancy will not occur bef ore six (6) months from the date\nof determination, the board shall establish a screening committee at least ninety (90)\ndays before the first date on which the position may be filled.\n(3) A screening committee shall be composed of:\n(a) Two (2) teachers, elected by the teachers in the district;\n(b) One (1) board of education member, appointed by the board chairman;\n(c) One (1) principal, elected by the principals in the district;\n(d) One (1) parent, elected by the presidents of the parent-teacher organizations of\nthe schools in the district;\n(e) One (1) classified employee, elected by the classified employees in the\ndistrict; and\n(f) If a minority member is not elected or appointed to a screening committee in\ndistricts with a minority population of eight perc ent (8%) or more, as\ndetermined by the enrollment on the preceding October 1, the committee\nmembership shall be increased to include one (1) minority parent. This\nminority parent member shall be elected by the parents in an election\nconducted by the local school board. Parents in the district shall be given\nadequate notice of the date, time, place, and purpose of the election.\n(4) Prior to appointing a superintendent of schools, the board of education shall\nconsider the recommendations of the screening comm ittee, but the board shall not\nbe required to appoint a superintendent from the committee's recommendations.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3721","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:08Z","sha256":"c55081fdd3ffeec95f5e213abc46057c3df7aec914a35e925f6931af34f7123e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.350","next":"us-ky/krs-160.360"},"notice":"GroundRules: Original legal text.
