{"data":{"id":"us-ky/krs-160.370","jurisdiction":"us-ky","citation":"KRS 160.370","heading":"Superintendent as executive agent of board -- Duties -- Duties of local","body":"board of education and superintendent in county with consolidated local\ngovernment or having five hundred thousand inhabitants -- Approval of small\npurchases in county with consolidated local government.\n(1) The superintendent shall be the executive agent of the board that appoints him or\nher and shall meet with the board, except when his or her own tenure, salary, or the\nadministration of his or her office is under consideration. As executive officer of the\nboard, the superintendent shall see that the laws relating to the schools, the bylaws,\nrules, and regulations of the Kentucky Board of Education, and the regulations and\npolicies of the district board of education  are carried into effect. He or she may\nadminister the oath required by the board of education to any teacher or other\nperson. He or she shall be the professional adviser of the board in all matters. He or\nshe shall prepare, under the direction of the boar d, all rules, regulations, bylaws,\nand statements of policy for approval and adoption by the board. He or she shall\nhave general supervision, subject to the control of the board of education, of the\ngeneral conduct of the schools, the course of instruction , the discipline of pupils,\nand the management of business affairs. He or she shall be responsible for the\nhiring and dismissal of all personnel in the district.\n(2) For a county school district in a county with a consolidated local government\nadopted unde r KRS Chapter 67C or having five hundred thousand (500,000) or\nmore inhabitants:\n(a) A local board of education shall:\n1. Delegate authority to the superintendent over the district's day -to-day\noperations and implementation of the board -approved strategic plan and\nbudget in a manner that promotes the efficient, timely operation of the\ndistrict, including but not limited to the authority over contracts related\nto daily operations of the district, pupil transportation, personnel\nmatters, and the organizational structure of administrative staff;\n2. By December 1 each year, approve a rolling five (5) year strategic plan\nfor the district that outlines student outcome goals, faculty and staff\nimprovement goals, facility and infrastructure improvement, and other\nkey objectives that the superintendent and board believe are in the best\ninterest of student outcomes and the community;\n3. Review and approve a rolling three (3) year projection of expenses and\nrevenues;\n4. Approve an annual budget for the district, which s hall include any\nbudgetary decisions relevant to the district's ability to obtain necessary\nrevenue, including tax revenue, in accordance with the requirements of\nstate law and regulation;\n5. By December 1 each year, oversee:\na. An annual audit of the financial dealings of the district and the\nreporting of key financial performance data in order to ensure fair\nand accurate reporting to the board; and\nb. An annual review of student performance in the district and the\nreporting of k ey student performance data to ensure compliance\nwith state and federal law and accurate reporting to the board;\n6. Recruit and hire the superintendent and negotiate the terms of\nemployment and compensation of a prospective superintendent;\n7. Complete an a nnual review of the superintendent's performance with\nregard to the duties assigned in subsection (1) of this section and\nparagraph (b) of this subsection; and\n8. Be responsible for the dismissal of the superintendent;\n(b) Notwithstanding any provision to the contrary in subsection (1) of this\nsection, the superintendent shall:\n1. Provide a quarterly, informational report to the board on the\nadministrative actions taken by the superintendent to carry out the\ndistrict's daily operations and implementation of  the strategic plan as\nwell as a budget to actual financial update;\n2. Prepare all rules, regulations, bylaws, and statements of policy for\napproval and adoption by the board, with approval not to be withheld\nwithout a two -thirds (2/3) vote of the board to  deny approval or\nadoption;\n3. Supervise the general conduct of the schools, the course of instruction,\nthe discipline of pupils, the employment matters of all employees and\ncontractors, and the management of business affairs of the district;\n4. Be respons ible for the hiring, employment terms, dismissal, and\norganizational structure of all personnel in the district in compliance\nwith all laws and in a manner that best serves the students of the district;\nand\n5. Notwithstanding any law that assigns an admini strative duty,\nresponsibility, or authority to a board of education, or other law to the\ncontrary, be responsible for any administrative duty not explicitly\ngranted to the board under paragraph (a) of this subsection;\n(c) If the school district adopts the provisions of the Kentucky Model\nProcurement Code, the board shall authorize the superintendent to approve\npurchases, in accordance with small purchase procedures adopted by the\nboard, for any contract for which a determination is made that the aggregate\namount of the contract does not exceed two hundred fifty thousand dollars\n($250,000);\n(d) The board shall authorize the superintendent to approve a line -item transfer\nwithin its annual budget as she or he deems necessary, provided that the\naggregate amount of all transfers do not exceed two hundred fifty thousand\ndollars ($250,000) per quarter. The superintendent shall provide a quarterly\nreport to the board on any purchases made under this subsection; and\n(e) Any purchase or transfer completed pursuant to p aragraph (c) or (d) of this\nsubsection shall be within the approved budget of the district, aligned to the\nstrategic plan of the district, and reported to the board at the next regularly\nscheduled board meeting.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57894","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:08Z","sha256":"d425e1aa3ac9fd33eff589c75de20859a1217df5989738a810a694307c8a011d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.360","next":"us-ky/krs-160.380"},"notice":"GroundRules: Original legal text.
