{"data":{"id":"us-ky/krs-160.720","jurisdiction":"us-ky","citation":"KRS 160.720","heading":"Consent to release of records -- Release without consent -- Waiver by","body":"student -- Records of release.\n(1) Parents or eligible students may consent to the release of written documents by\ncompleting and signing forms devised by the educational institutio n identifying the\nrecords to be released, the date of the release, the party to whom the release is\ngranted, and the purpose of the request.\n(2) Educational institutions shall not permit the release or disclosure of records, reports,\nor identifiable inform ation on students to third parties other than directory\ninformation as defined in KRS 160.700, without parental or eligible student consent\nexcept to:\n(a) Other school officials, including teachers, with legitimate education interests\nand purposes.\n(b) Other school systems, colleges, and universities to which the student has\nsought enrollment and transfer, or from which the student was graduated.\n(c) Federal, state, or local officials who carry out a lawful function and who are\nauthorized to receive this in formation pursuant to statute or regulation. This\nauthority includes requests from any agency of the federal and state\ngovernment for the purpose of determining a student's eligibility for military\nservice.\n(d) Federal, state, or local officials to whom th e information is required to be\ndisclosed or reported.\n(e) Individuals or organizations conducting legitimate studies, surveys, and data\ncollection in such a manner so as not to permit personal identification of the\nstudents or parents.\n(f) Accrediting organizations enlisted to carry out accrediting functions.\n(g) Parents of a dependent student of the parent as defined in Section 152 of the\nInternal Revenue Code of 1954 (26 U.S.C. sec. 152).\n(3) Students may waive the right to inspect confidential recommend ations relating to\nadmission to educational institutions, application for employment, and receipt of an\nhonor or honorary recognition. In the case of admissions, the waiver of release shall\napply if the student, upon request, is notified of names of person s or organizations\nmaking confidential recommendations, and those recommendations are used solely\nfor the purpose intended.\n(4) Records of release for information contained in education records, other than\ndirectory information indicating the agency, insti tution, or organization that has\nrequested or has had access to student education records and indicating the purpose\nof the release or inspection shall be maintained by the educational institution. These\nrecords of release shall be limited to inspection by  parents, eligible students, school\nofficials and their assistants who are responsible for custody of education records;\nby school officials within the educational institution who have legitimate\neducational interests; and by federal and state officials an d representatives\nconducting audits and evaluations of the education programs or in connection with\nthe enforcement of federal or state legal requirements relating to the programs.","path":["KRS Chapter 160"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=3818","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:09Z","sha256":"c20d50cb894e1636c7c4570a4376f9a44ca84b5661f081caf15a3e4726db0fbb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-160.715","next":"us-ky/krs-160.725"},"notice":"GroundRules: Original legal text.
